can a disqualified director make the ultimate decision
Comments
-
No but it is the promotion of a business which a disqualified director is not allowed to act in0

refusing me time off to take my disabled child to a hospital appointment where they allow other members of staff time off and refusing me holiday pay, even acas said they should have doubled my notice period to allow me to take my holiday entitlement. Disability by association and to gain holiday pay back.
Thankfully I have colleagues who also walked out because it was so bad, they were being forced to work on call when they were told they would never have to.
If I get home at 4pm and work for 5 hours solid that night because the phone is going mental with bookings then that is time I have worked for nothing.0 -
So the majority of people on this thread actually believe it is not right to stand up for your rights, allowing people who break the law to make people work for nothing, discriminate against you for having a disabled child and not pay your holidays. Glad I do not work for any of you.0

This is where you should have exerted your rights, simply walking off and resigning is unlikely to achieve much except cost you a job.Thankfully I have colleagues who also walked out because it was so bad
Again, this doesn't deal with the problem - it becomes an exercise in futility at this point.
Collectively the employees need to get organised.Disability by association
What do you mean by this?.
As i asked last night, in your ET submission, which regulatory breach are you claiming re the loss of pay?Don’t be a can’t, be a can.0 -
Proving that this person is acting as a director when he should not will not bring you a millimetre closer to getting whatever rights you are trying to claim. In fact, you have so hidden the issue over your rights under your issues with this particular person that I have no idea what rights you are fighting for.So the majority of people on this thread actually believe it is not right to stand up for your rights, allowing people who break the law to make people work for nothing, discriminate against you for having a disabled child and not pay your holidays. People are telling you that you are barking up the wrong tree. You could get this person removed from his position, you could get the Department of Trade to sanction him. But it won't help you with quest.Hi, we’ve had to remove your signature. If you’re not sure why please read the forum rules or email the forum team if you’re still unsure - MSE ForumTeam0 -
THe majority of people on here, who have answered you, DO believe it is important to stand up for your rights. THey probably wouldn't want you working for them either. THe majority of people here give up their free time to help others stand up for their rights, but when there is no wrongdoing, and there is no evidence of wrong doing from this thread, then they will also tell you it is time to put up, shut up and move on.
What has not been established, as most of us do not expect to go delving into several threads to decide what the hell is your beef, is understand what you are upset over .
From reading this thread, you asked about a director working. He is working as a manager, and therefore is able to make operational decisions as per his remit. No case to answer.
If you quit, the company can (and indeed should) include holiday pay.
And if being on call is you working 24/7 then no wonder relations have gone sour - being on call is being on call, and 1000s do it (without pay - some of us don't even get paid when we are "called")0 -
I did on call as noone else liked to do it, I was offered time off for my disabled childs hospital appointments in return for being on call, however when it came to using that time off they refused. Not what was agreed to, I would never have agreed to doing 3 weeks on call and one week off if they infromed me it was for nothing I certainly would have agreed to doing my fair share if it was part of the job and each member of staff take a week in turn but there was me doing on call and noone else doing it.0

You should learn assertiveness or you run the danger of this kind behaviour following you through life.Don’t be a can’t, be a can.0 -
I did not quit, quitting in my eyes is walking out, quitting for no reason I handed in notice and my letter specifically said it was due to them not being able to compromise on a fair arangement for me doing on call. Which then leads me to other questions, did they see me as an easy target as I was a single parent wih a disabled child and just thought I had nothing else to do besides doing on call. I as I am sure many other people would never agree to doing that level of work unpaid, especially when your only earning a poxy £6 an our for the work you do in the office.0

I am assertive, but would not put up with the verbal abuse from some jumped up illegally acting director. He claimed if you dont like it you know what to do (gestured towards the door). I am just thankful I was not the only one who walked out0
