    Which they are allowed to do. An employer has the right to insist that holiday is used during the notice period.

    but they did not inform me, they specifically said they would pay me to the end of the week, my notice letter set out everything I expected to receive and they at no point indicated that my final week would be holiday, the contract stated one week notice is to be paid, they are not consistent with enforcing that everyone should use holidays as notice.

    I worked 40 hours per week in the office plus unpaid work on call outside office hours, so techinically I was working 24/7

    on call is not "working" so technically your were NOT working 24/7

    You are confusing how !!!!ed off you are with them with a legal case. They aren't the same thing.

    I handed in notice, prepared to work it, they chose for me not to work it, informing me I would be paid the notice till the end of the week, however pay day came, no holidays were on it it arose that they decided to use my holidays as notice period, without informing me.
    Suppose you go to tribunal and you huff and you puff and you blow their house down, proving that this 'manager' is acting as a director. To win your case, you actually have to prove that the decision was wrong in law.

    As far as I can see, proving whoever it is who is calling the shots is irrelevant to making a decision on whether you have been treated correctly in law.

    As a lorry driver, I was the first point of contact with potential clients. As a signwriter who goes on site visits, my wife does that too. Neither of us were acting in the management of the business.

    So going on the above sentence, any employee of a company who goes out looking for new clients is acting in the management of the business? Riiiiight.
