Just because the needs are there is not sufficient, you have to show that those needs cannot reasonablly be accomodated by using special equipment. Do you honestly think that you could argue that you are unable to get up and down stairs for example, when a stair lift would solve that particular problem?

There is no funding for 'special equipment' in the vast majority of cases.
From memory, there have been decisions that suggesting 'some bit of basic equipment that is present in most homes' for 'special equipment' is not unreasonable, but that saying 'you have no care needs, that are not dealt with by this 10000 pound robot' isn't.
Suggesting a stairlift to someone on benefits, when there is no funding to buy it, for example isn't helpful.

There was another comment by a tribunal along the lines of 'The cooking test is not solely about the claimants ability to produce a main meal, it is an assesment of their general disability.'

DLA should help with general care needs - and not solely mean you are helped with only the specific tested activities only.

But isn't that why there was that ooohah about the squaddie that managed to walk onto the football pitch on two false legs, had claimed DLA for having no legs and lost his DLA mobility element because with the two false legs he wasn't said to have high mobility needs?

I have absolutely no idea. I am merely passing on the information the WRO gave me.

I'm sorry but I would disagree with that. If it can be shown that there are ways round things that help to avoid having problems with care or mobility they are and should be taken into account.

My wife's AA claim and appeal at a Tribunal failed for two reasons.
one she has major water works problems and severe Arthritis which means she would have to go up and down stairs to the toilet every 30 mins. The Tribunal said a comode downstairs kitchen or lounge would solve the problem. I accepted that I could empty it when I was asked by the Judge. Second, because she can't stand still or in one place for more than a few minutes means that she can't prepare a meal. The tribunal told her to get a stool to sit on at the sink and cooker.

You have been banging on the same drum since you were andyandflo troll, you had DLA if we believe your lies and then decided you didnt want it anymore and the commode in the kitchen is a stroy you trot out in every AE but since you lie so much its most likely that you have persuaded yourself it true like your suicide, BMW and having loads of money :rotfl::rotfl::rotfl::rotfl::rotfl:

No one wants trolls here, people fall for your rubbish and lies but thats becuase they dont know you and what you have done in the past but i and many other are willing to tell them!

Sorry, what are you talking about?

I have never had DLA. I only claimed it last year and was turned down in Jan this year.
As for the rest of your post, it makes no sense at all.
As regards what the Tribunal said, I can assure you that that is what happened. I actually have the written notification as well in which they used those arguments as the reason for the refusal.

If you know about my life, then please enlighten everybody! Having never spoken to you at all, you must have a very rare medical condition relating to mind reading!

Why don't you go away and attack someone else with your disturbed opinions and comments?

Almost the same speil as usual andy, your a very bad troll who cant help but out themselves in everysingle post and no one has ever posted the same scinario as you verbatim as so many AE's.

  • My dla was given to me in 2009 indefinitely, now they say i cant have it-nothing has got better...so i'm really not sure what indefinitely means on the paperwork any more.
