I found a like to the DMG, so got my answer. The value of the house is disregarded for 26 weeks from when it's put up for sale. So if that's not till next spring, it'll be classed as capital and my benefits will stop until then.
There was something about if the claiment has no choice in the matter, but that seemed to be legal things, like being given money for x purpose, not for tenants in common when the other tenant refuses to sell.

Hmm, I've just read an updated version of the DMG, which seems to say that as a tenant in common where the other person is unwilling to sell they can only count as capital the market value of my share in the house, which as there isn't much of a market for half houses wouldn't be very high.
I think I'm just going to have to write to them in as much detail as possible to get their agreement on things. It's going to be a long letter...
Does anyone know if I get a chance to go and speak to someone at the JC about it? Because the whole thing with dad buying the house makes it so complicated - mum's house wouldn't be going on the market at all, his would, which really mucks up the disregard timescales. Just an update.
I paid for mum's funeral last week. Her bank tried to tell me that it needed to see a grant of probate before releasing the funds, so thanks to this site I knew the rules and stood my ground. so that's one thing done and not to worry about.
Sister's agreed with me to put the house on the market as soon as probate is granted, if dad wants to buy it he can do it like anyone else would.
I contacted the probate office today, they said I can drop the forms in there (which is good cos dad's really panicking about having to give me his divorce papers for them), but they can't go over the forms with me, which is a shame. I guess they'll let me know if anything's wrong, but it would drag things out a bit more.
I still haven't heard from DIAL, I'm going to chase them up tomorrow. I'm worrying and panicking about the whole thing so much that I need to get things settled so I know one way or another. I've been self harming, and comfort eating so much that I've piled back on the couple of stone I'd lost, which can't carry on. I'm going to look into private counselling, but the stress of all the benefits/inheritance stuff really needs sorting if I want to get things on an even keel.

I've just spoken to DIAL and they said that there's no way I'll be able to get permission to buy a house, and if I do I'll be treated as having notional capital.
No idea what to do now. I guess that I've got nothing to lose by asking for permission and putting as much info as I can, including doctor's letters about this place not being suitable.Unless I say otherwise 'you' means the general you not you specifically.0 -

Hi all,
After my diagnosis of diabetes yesterday I've realised that I have to get out of this flat - given the problems with extremities, I need somewhere with heating so that I don't get complications in winters.
I fully appreciate that buying a house will most likely lead to me being sanctioned for IS.
I just want to check though the situation with council tax benefit. I assume that they wont class it as deprivation of capital, as I'm saving the council a fortune in HB?
I'm trying to do the sums and a new budget and just want to be as accurate as I can.

Reading with interest. I can at least answer the last question for you - you can only edit it for a fixed period of time, but the board guide on that board (NOT any random BG, so I can't do it as not my board) can edit it for you at your request
