Not difficult if you have care and/or mobility needs - although some may disagree.

The Disability and Dosh forum has lots of examples to illustrate.

Personally, I don't think it is difficult if you meet the criteria.

You may come across people saying that everyone is turned down on their first application, or it's much harder to claim because the Government are trying to save money, but that isn't the case at all.

Have a look at the criteria for DLA, which is based on care or mobility needs, and see if the situation would warrant an application.

No they dont, some applicants may have have a ATOS assessment but many dont if they can supply enough evidence of their mobility and care needs.

And DLA isnt an out of work benefit, you can work and claim DLA.

There are places similar to the Citizens Advice who'll help you to complete the forms.
Ask at your local Council offices.

My ref to atos was such that they seem to do their best to not award genuinely ill people with what entitled to, of course you can work with dla. But dla is harder to get and if refered to atos even though they of course should listen to doctors and specialists, they dont tend to, or otherwise so many people sent to atos for esa and dla or already on IB and dla wouldnt be finding that being not accepted for change for IB to esa also in cases wipes out their DLA as well.

I am on dla and still getting it so just though warning re atos was a fair comment as some cases do end up before them. RE evidence my condition is mental and neurological, I have two arms, I have two legs that thankfully look after me till my brain decides other wise. Trying to explain to atos how such a person can be so ill when they are all likelihood either midwives or whatever but rarely doctors, is a guaranteed in most cases fail.

You then have to appeal like the many others and hope you see a real doctor.

Just because not all are in front of atos, does not mean you wont and in all likelihood we all will be sent there for the dla benefit at one time or another.

Although many claimants are sent to see somebody from ATOS, most have not had to as yet (I haven't met anybody at all, and I am quite active in the disability community in my town).

I agree with Pipkin - it is not difficult if you meet the criteria. My son has received HRC since he was three months and HRM since he was three years - the earliest ages possible. He has always had (and still has) substantial care needs both day and night, as well as major problems with mobility. His award has been indefinite since he was eight, which I believe is unusual for children as they change and develop so much. I have no reason to believe that his award would change if he was reassessed tomorrow.

Despite knowing so many people with disabilities, I have only met one person who was wrongly turned down for DLA, and that is because the school wrote an inaccurate report (which was proven inaccurate to the tribunal, which then awarded a reinstatemnt of HRC and HRM).

Well for those of you not prepared to meet atos re dla, then get prepared because esa and dla will come under the same scrutiny. Even those awarded claim for life etc...will get retested.

Until DLA changes to PIP ATOS won't play a major part. Non-one i know on DLA (myself included) has had to deal with ATOS for DLA yet. Not saying it won't happen but at the minute it doesn't seem to be as much of a problem, if you have the care/mobility needs hopefully your form along with supporting evidence will suffice.
