Speedy dosh /NDR / Marshall Hoarse Bailiffs

Hi a friend of mine has got into difficulty over a payday loan. He borrowed £100 before xmas, ive no idea if he has made any payments to it at all. He lost his job in January and is claiming benefits but is constantly being phoned and receiving text messages from above , latest being the bailiffs.

They are stating that they will being doorstep proceedings in so many days and he has no idea what to do.

Ive no advice to give him as i dont know myself, he is in Scotland if that helps.

Any advice i can pass on, thanks .

    I'm impressed that a company with a name like "Speedy Dosh" actually turned out to be money lenders!!

    Has he actually made any effort to contact them to discuss his situation?

    Ms D complains that Marshall Hoares Bailiffs Limited (MHBL) added unfair charges to her account
    and harassed her in pursuit of a debt.

    our initial conclusions

    Our adjudicator recommended that the complaint be upheld. She found that MHBL added charges
    to this account after Ms D told it of her financial difficulties; she did not consider this to be
    reasonable. Our adjudicator also found that MHBL’s communications with Ms D did not meet Office
    of Fair Trading (OFT) requirements. She recommended that it reduce Ms D’s outstanding debt to
    £359 and pay Ms D £200 to reflect the distress and inconvenience this matter has caused her.

    my final decision

    I have considered all the available evidence and arguments to decide what is fair and reasonable
    in the circumstances of this complaint. Having done so, I uphold this complaint.
    Ms D was lent £200 by a company affiliated to MHBL in April 2012. Ms D suffered financial
    difficulties and was unable to repay the debt as planned, incurring late payment charges. She
    informed the lender of her situation in June 2012 and tried to negotiate an affordable repayment
    plan. Her lender rejected this and referred the debt to MHBL, adding further charges to the
    account. Both companies sent aggressive emails and texts to Ms D demanding repayment.

    I find that MHBL added unreasonable charges to Ms D’s account after she said she was in financial
    difficulties. I am also satisfied that MHBL’s communications did not meet the requirements of the
    OFT’s debt collection guidance by “putting undue pressure” on Ms D. It follows that MHBL should
    compensate Ms D for this.

    My final decision is that I uphold this complaint and I order Marshall Hoares Bailiffs Limited to pay
    redress as set out in full overleaf.

    No ,hes burying his head in the sand so to speak. The £100 that he owed has turned into £620 .

    Hes worried that the bailiffs can just turn up and take his stuff.

    I may be wrong, and I'm sure others will be able to help more, but I didn't think you had bailiffs in Scotland anymore?

    I think they are an English company... and from trying to find out about them it looks like they are all the same company but different departments. Ive no idea if bailiffs are allowed to operate in scotland.

    Hi, me again, back onto same problem, according to him ,he hasnt heard anything from them for a while then recieved this email. Is it scare tactics or have they did this before.


    We have reason to believe that you have supplied our client - Speedy Dosh-Speedy Dosh Loan - with potentially FRAUDULENT information inorder to obtain credit.

    THIS IS A SERIOUS MATTER which must be dealt with IMMEDIATELY to avoid further action.

    Call 0843 381 0843 IMMEDIATELY failure to do so may lead to this matter being passed to the Police

    According to records you applied for and took credit with Speedy Dosh-Speedy Dosh Loan on 15.12.10 00:00.This debt now totals GBP 560.

    If we do not hear from you by end of tomorrow we will be passing this file to the Anti Fraud Department who will then perform further traces.

    If this proves to be an attempt to defraud then you will be charged for the extra investigation and the file handed to the Police to pursue as a criminal matter.

    We w ould much rather avoid involving further third parties as it will become much more serious and expensive for you, and time consuming for us.

    CALL NOW TO AVOID FURTHER ACTION

    I doubt whether the Police will be interested in this, however if they were to get involved it might make people think twice before taking out a loan and not paying it back when agreed.

    The section above which I've highlighted in italics sounds to me like blackmail - "if you don't do this, we'll report you to the police. Give us some money and we won't".

    Any decent law-abiding company would be on to the police immediately if they suspected anything and they wouldn't warn you beforehand.

  • It's worth noting that Greg Campbell is not a real person either.

    This loan will end up being passed on to Marshall Hoares Bailiffs who are essentially the same company with the same staff answering the phone. They're neither bailiffs nor are they too savvy with a) the law b) the OFT.

    I would assume that because they're dealing with this that Speedy Dosh are part of CIM Technologies who have had a telling off by the OFT - it's worth referring this document to them: oft.gov.uk/shared_oft/press_release_attachments/cim-requirements.pdf

    They are near enough useless to deal with, they won't sign any recorded letters and they very often won't respond to email. They will threaten you with bailiffs without court orders and similar intimidation - even if the person is based in Scotland. Complain to the OFT and FOS, call them and record EVERYTHING they say.

    As of yet, they've never taken anyone to court so certainly never obtained a CCJ against anyone. The Ministry of Justice do NOT recognise them as bailiffs so they have no power against you in your house - ultimately, you should not be paying more than the principal and one months interest. If your friend is on benefits, he should offer them the token payment of £1 as this is not an essential debt.
