Its not just getting DLA, its keeping it...!!!

Its not just the issue of getting the award in the first place, its the issue of keeping it now that DWP under pressure from Government to reduce claimants. I had DLA Life award at Higher rate mobility and Middle rate care - enjoyed benefits for 12yrs until: _pale_

Failed to realise a “Life” award is not for life despite what it implies on the paperwork!?! :doh::doh:

That you need to notify DWP-DLA of any little change of circumstances, to include: :shocked:

Any possible change to your lifestyle.
Any temporary change of address.
Any noticeable deterioration of condition.
Any new additional medical conditions.
Any change to your private, personal relationships or status.
Any accidents or incidents that might affect your condition.
Any other issue that affects you - whether personal or private.
Even extended holidays abroad...ie more than the regular couple of weeks.

Finally, to naively believe that being honest and telling truth things will ok in end._pale_

Whilst the HUGE amount of extra paperwork received by the DWP might cause a backlog and bog the system down but there is really no choice as found out to my cost! And they do ask you to keep them informed after all!!! :mad:

It cost me - as without medical evidence of any nature against me, my award was suspended as failed notify change in circs when moved address and became single again during a messy divorce. But now despite attempts to get my DLA award reinstated or new claims made with a severe worsening of my condition, they all have been declined despite appeals, tribunals or worse! :angry:

So now think I'm being judged by my apparent failure of the past rather than my current situation as appear "blacklisted" from any future award to the detriment of my Human Rights. :mad:

Sorry to appear a scare monger...

But doesn't matter to them if you've had award for 20+yrs, severely disabled, an OAP etc you're just considered by them an easy target...you're still just a potential target for their statistics! :(

So to paraphrase: CAVEAT EMPTOR applies!! :mad::mad::mad:

    You will not be blacklisted due to a previously declined award, and I fail to see where your 'human rights' are affected.

    Well have made 3 new claims all declined saying have not enough issues to even rate the most basic award...so appears am a medical miracle as my three recognised medical conditions which will only deteriorate - have got better <not!> :mad:

    Have you submitted medical evidence in support of your claims? Have you received assistance from CAB, DIAL etc with the claims and appeal process?

    Have you not got in your area a disability resource place that can help you will the forms/advice etc

    When my daughter got turned down twice we went to local disability Action Group who filled in forms for us

    You [ and soon to be many many others ] are I suspect in what was / is still called the ' self certification ' group.I don't know without looking it up when in recent history self certified IB50's were discontinued, but they have not been allowed for many years. ATOS has been active for many years I suspect the demise of self certification & ATOS will have been connected.

    You certainly need to apply again and get professional [ Citizens Advice etc ] help however, without medical evidence no one on the planet will be able to even begin to help get you sorted, and self certifiers will be an easy target for the penny~counters to attack.

    Get yourself back in to the medical system, start to generate a paper trail of evidence backed diagnosis.

    My full medical records submitted but DWP-DLA have habit of interntionally or unintentionally finding any potential weak spot e.g. was referred by my GP to a Lottery supported charity that helps those who suffered stroke or have poor mobility to get some light exercise in a supervised controlled safe enviroment - not a gym or leisure centre complex.

    The DWP-DLA adjudication officer took this that I was going to the gym and working out 2-3 times per week so obviously couldn't qualify for DLA.

    It took several letters including full A4 from my GP to explain and supposed get that part of decision against me reversed but DWP-DLA just concluded that no new evidence had been submitted to change the decesion based majorly upon this error!

    Have an extensive continual and regularly updated medical history over last 20+yrs. Haven't self-cerified myself when in work in god know's how long, never needed too...if was able to work despite my disability I did and never used it as an excuse for time off etc.

    It is only in last 8 months that been unable to be involved full time work and that due to mobility issues due Post Deep Vein Thrombosis condition and cellulites in legs combined with older problems with lower spinal injury and severe arthritis.

    So medical trail is there and infact waiting on two hospital appointments one as day patient for steriod injections and other as in-patient for surgical issue - both due to my medical condition and mobility.

    Thanks for advice, will follow that one up. :T

    Though need to leave it at least six months between applications or they can hold previous decsion for refusal against you!

    ATOS has been active for many years I suspect the demise of self certification & ATOS will have been connected.

    ATOS and their staff leave alot to be desired espcially the "doctors" they employ to do their medical assessment either at home or in their assessment centres.

    Many are NOT able to qualify to work within the NHS system, either due to language issues, qualified in own country but not being qualified enough by NHS standards or elderly retired GP's are common.

    Had one assessment with ATOS doctor who spoke barely any English as he was Polish so any interview by him was limited as needed to break it down to a more basic level to give answer to medical question that he showed me on piece of paper so I understood it! :mad:

    Needless to say that appliaction wasn't successful!

    Lets face it most doctors who are qualified for working in NHS, not just UK can earn a better living in an established health environment rather than word for ATOS - plse note not saying all ATOS staff are poor just many of the Assessment Doctors or so people say!

    - most who work for ATOS are not doctors at all
    - but all are medially trained to a functional level
    - and all are certificated to a pre-required DWP criteria level
    - all do an excellent job, their job is ' can do ' - not - - ' can't do ' profiling
    - the profile ATOS have to reach contractually is a 30% reduction in claims

    It's well known how badly ATOS is perceived by everyone and every organisation .. .. .. read Hansard, and everything else on planet UK. They were charged with wielding the axe and do so with glee!
