Get your mum to call her card issuer to ask them to do a chargeback for non receipt of services. As the company went bust recently they'll be able to do this for her.
Thanks I've written down this info for her and she is going to get in touch with her bank today (Yorkshire bank).
I find it hard to believe we are the only people who have contacted paypal about this though, especially since the message on the Helitours website says to contact paypal.0 -
Yorkshire bank have told her because the card is a maestro not a mastercard they can't do anything :mad:0

Note the bit where it says "It applies to all debit cards".Chargeback is not enshrined in law like section 75, but is part of Scheme Rules, which participating banks subscribe to. It applies to all debit cards, although exact rules may vary between the Visa, Maestro and American Express networks.
Maybe Yorkshire Bank need the scheme explaining to them.
This is not a surprise.

The bank are correct, there is no protection for non receipt of goods/services when paid for using a Maestro card, either by chargeback or Section 75. Section 75 only applies to Credit cards anyway.

Yes, we know that section 75 only applies to credit agreements, and MSE's article makes that clear.
Would it be a good idea for you to send an email to MSE, maybe via [EMAIL="forumteam@moneysavingexpert.com"]forumteam@moneysavingexpert.com[/EMAIL], advising them to remove the Maestro card image from their article?
Because at the moment, their article is slightly misleading.
It does seem strange that both MSE and Consumers Association have both made the same mistake.
However, having said all that, it seems you are nearly right, Meer53.
On page 3 of this document from The UK Card Association it says...
The card schemes’ (Visa Credit, Visa Debit, MasterCard, Maestro and American Express) who have put card operating regulations in place across the world permit chargebacks for a variety of reasons - depending on the type of card used. Unlike Section 75, chargebacks do not have transaction limits, so you can initiate a chargeback on purchases for any value, including those below £100.
It then goes on to say...
[Note: if you used a UK issued Maestro card then a chargeback will only be processed for goods not received if the order is placed with an overseas website.]

There are some chargeback rights available for Maestro transactions, but none for non receipt of goods/services. It's so long since i had a Maestro dispute, i can't remember what the others were, i know there was one for cancelled continuous authorities and one for unauthorised transactions and others which covered fraudulent transactions. My bank stopped issuing Maestro cards long ago. The overseas scenario does seem to ring a bell somewhere in the back of my mind !! If someone asks me to deal with an old Maestro dispute or fraud query, i have to dig out all my old training notes from about 1986 !0

we too booked this in december, and booked our flights for 30 April which Helitours then cancelled, they had given us new date of 30th May , but I rang up earlier last week to cancel this date, and they advised us to ring back in two weeks.
noticed last night on here that company gone into administration, so rang Nat West today, and explained what has happened, spoke to a lovely lady, who is sending us a claim form, and asked us to provide copy documents regarding our flight, but anything else that we have.
we paid by Visa Debit, so hopefully we will get a refund.No. 83 in £365.00 in 365 days 17/365
