Hi
My husband brought me a necklace and bracelet set for my 30th birthday in October, less than 3 weeks later both broke within two days of each other. I took them back to my local store with the receipt to see what could be done as they had hardly been worn. They were sent off to their quality control department and i was told they would be back by the 4th December.
Yesterday i phoned the store to fond out what was happening and was told that QC decided that they had been subjected to excessive crushing and were damaged beyond repair. H Samuels have stated that they are unwilling to do anymore as its not their fault.
ALthough i understand that its not their fault i also dont expect to buy something and have it break in less than 3 weeks.
Does anyone have any advice about what i should do next as at the moment im totally unsure.
Thanks
Bec

I don't quite understand. Are you saying that you crushed them yourself?! What are they made from?0 -
no i didnt crush them i just wore them!!!
they broke but rather than replace them and admit that they were poor quality they have said that they were damaged by excessive crushing. Im just not sure what my rights are0 -
Seems like an excellent advert for H. Samuel. Perhaps we all should shop there.0

becian,
Have you had the items returned to you? If so, are they in the same condition as when you sent them, or worse? Whatever the present condition, presumably you have witnesses other than your husband as to the condition. (If they don't believe you, they won't believe your husband).
When they are in your possession, try getting a free assessment from an independent jeweller. Also try your local Trading Standards office for advice.
Another possibility - how did your husband pay for the items? If by credit card it might be worth discussing with the card company.0 -
Thanks for the advice. He paid cash for the items, I am supposed to be collecting the items from the shop but have put it off in the hope that they may lose them if they have them too long. Wishful thinking i know but hey.
I have emailed their cs but have not yet had a reply so will follow it up after christmas

Get them back then contact trading standards. If they have crushed under normal wear then they are not fit for purpose. H Samual sell over priced crap jewellery. It looks good but it's hollow and poorly made so I would demand a refund not a replacement.

sorry to hijack your thread....I am having a similar problem with Symmingtons. i bought daughter a silver tennis bracelet ( fake diamonds ) for daughter for christmas .It only cost £40 but the second time she wore it. She is 21 so does take care of her jewellry. One of the diamonds fell out.took it back today and the girl said she'd have to send it back and it would take approx 6 weeks.i paid for it on my Visa card.any advise ? should they not have replaced it ? 6 weeks is a long time. I did expect slighty better quality for £400

Brings back Gerald Ratners comments on his company....Don't bother trying to sue me - I've got no money!0

They would be entitled to repair it in the first instance, but if the diamond then fell out again you could ask for either a like-for-like replacement or partial refund.0

I spent around 8 months, having to pester H Samuels customer service to sort out the refund they were meant to be processing.
I know all there is to know about jewellery trivia, thanks to the tedious soundtrack they play when you're on hold. The ladies were sweet but there must be a serious departmental problem there - nothing ever seems to get done.
Good luck. I've not shopped there since. My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0
