Lloyds credit card charges offer!!

Hi all,

i recently sent a letter to lloyds tsb regarding claiming back over £400 in charges most of these consisting of £12 charges and some at £20.

I have had a response from them offering me £25 and saying that they now consider the case taken care of.

Going to write back now threatening court proceedings.

A similar situation i had with my bank charges and after a pants first offer i sent them a second letter then they gave me a much greater offer.

  • Late charges etc. Just realised that they haven't been charging me any interest on my balance so for that reason i am going to let sleeping dogs lay i think.
  • that sounds reasonable enough. if you write a second letter, you may possibly get more of a refund, but if they are legitimate charges i wouldnt count on anything
  • Yeah think your right there. Not gonna stir up a hornets nest, after all the interest per month alone on my balance is £130 ish

    how would late payment charges of £12 (or over) be legitimate charges unless they're the bank's true admin costs?

    how do you think a bank makes money? from giving you interest on your bank account? no. this is how. is £1.25 the true cost of a loaf of bread. does it cost a brewery £3.50 to make and transport each pint of lager it makes?

    its part of the signed contract and if you are late paying, you should KNOW you will be charged because it is part of the deal.

    if someone told you not to go near a fence because it is electrified, but you go over there and stick your hands on it, who is at fault?

    You're not much of a 'expert' are you?

    You should know, for an expert, that the bank is not allowed to make profit from a customer's breach of contract but only charge enough to cover their costs, this is in law. I'm sure you're aware of the lawful basis under which people make their claims and why this figure got reduced to £12 (by choice after the OFT report of 2006)?

    So you're admitting in your post above, as an expert, that a bank makes money from possible unlawful charges?

    Do you know if the contract has been individually negotiated and is in in plain intelligible english (PIL) and are charges a core service of the agreement? If not, then why does Reg 5 and 6 of the unfair terms regulations not apply or common law precedents on penalty charges?

    You're getting into contract law now and nothing to do with a breach of a consumer's agreement. A bank is not allowed to make profit from a breach of duty.

    Buying and selling goods does not come under a breach of contract, does it? If it does, how?

    £20 says it the same company (for want of a much more impolite word) thats in my signature. (I am judging this on the fact everyone there thinks they are an expert because of all the "training" they have in being [STRIKE]reasonble human beings[/STRIKE] automated robots)
    No Longer works for MBNA as of August 2010 - redundancy money will be nice though.
