    The problem is the customer has no contract with the manufacturer. The OP's contract is with the retailer.

    Now if there is a fault and the manufacturer has a 12 month guarantee then the retailer is the one who has to honour that warranty, they in turn would have there own contract and hence guarantee with either the distributer (who has there own contract with the manufacturer) or direct to the manufacturer that they should call on for reimbursement of costs or repair of the device.

    Now as you say in many cases you get better results going to the manufacturer direct and they may prefer it (ie Apple) as they have control but it doesn't change the fact that you contract is with the retailer, and any legal recourse has to be to the retailer.
