How is someone supposed to appeal within the time limit of 1 month if they aren't being notified within that time scale?
Zero points? Does that mean you were taking the !!!! while claiming ESA? Alternatively, you are being made a scapegoat to make "savings". I say Appeal, Appeal, Appeal! Sad way to look at it, but even if you don't win, you are costing taxpayers loads of money for costs of Appeal Tribunals... this means if everyone did so (which is your right) then the higher number of cases and cost is going to make MP listen. Already the Atos medicals are raising numerous questions because the appeals in general for many have been quite successful which raises questions as to what the medicals are really about and whether its creating wrong decisions.0 -
Just to add... you can ask to appeal outside of the timescales in special circumstances. Whether or not they will accept the appeal is another matter entirely. It doesn't quite work as having timescale from the time you receive notification however if you appeal at the earliest possible stating you received no notification then they might consider your appeal.

I have no cartlidge left in my knee and am waiting for a knee replacement op and I also suffer badly with anxiety especially in early morning, but I have an additional quandry that if I go over to JSA I am £200 per month better off due to an insurance policy I have which I could not use on ESA as it did not cover accident or illness, I will ponder a bit.0 -
Had a letter from DWP today, they wont back date my claim from when ESA signed me off as they said I had not satisfied the labour market conditions and I have not shown good cause for the delay in making my claim, so because of the DWP's incompetance and stupidity I will now appeal this decision as I have no way of losing the appeal, I wonder how much the appeal process will cost the taxpayer compared to the six days benefit they have to pay me.
Does anyone with brains work for the DWP ?0 -
Hello.
Please don't be offended by what I say, it's just the title of your post seems to suggest DWP have done something wrong.
If you are sick, you go to the doctor and get a sick note. You know full well the dates that the doctor agree's and signs you off. It is discussed between you and doctor before he/she writes anything out.
If you want to stay away from work - then you make sure work has a sick note. No?
Then if DWP don't pay you, why is it their fault?
Sorry but am I missing something?
Yes, you are.0 -
nashly, if you want help from the many DWP employees that post on here, you might want to edit post #14.Gone ... or have I?0

Well, surprise surprise after I phoned with my query yesyterday I received a letter stating I scored zero points and that's why they stopped my benefit on the 4th of May, are they not supposed to give me notice so at least I could plan my next course of action ?
Why do the DWP seem so incompetant.
Ask them to send a GL24 so that you can appeal.
You have a month from the date of the letter.
The appeal will probably take months, due to the backlogs, but you will remain on ESA assessment rate until it is heard.
