Help needed! issues with carphone warehouse

Hello
I recently purchased a new pay as you go nokia phone from the carphone warehouse. Since the day I purchased it this has not worked properly. Admittedly I took my time taking it back into the store 3 months, the phone kept turning itself off and they sent it back for repair. This got sent off for repair the salesman said that if this happened again they would replace the phone. Within a week of receiving it back it has stopped working properly, it is now bleping like a pay phone when you make a call.
I went into the shop after work today and they refussed to replace the phone with a new one only offered a refurbished one. Why should I accept this I purchased a new phone why should I settle for a second hand one.
What can I do please help im going in again tomorrow as the manager conveniently was not there.
Any advice much appreciated.

    They don't have to replace it at all, even with a refurb, merely offer a repair to be within the law. You handed in a used phone that was three months old, a brand new replacement won't happen. If you wanted a brand new replacement you should have took it back when you first experienced the fault.

    Unfortunately, if the condition of the replacement phone is not worse that the one of yours, they are within their rights to offer you a refurbished handset.

    Actually, they will replace it with a refurb in this instance under their First Time Fix policies.
