Vodafone Contracts???

I took out a 2yr contract with Vodafone but then went to work abroad so the contract was transferred to my brother and also the direct debit. Over 1 yr later whilst working in the UK I purchased a contract Modem with Vodafone (cannot remember the length) for £15 per month using my bank account details. I have hardly ever had the need to use the modem as most of the places I work have broadband & let me have the code.
Since the original phone contract was taken out 2 yrs has passed & my brother has now extended the original contract. Like most people he does not break down his bill every month but has noticed it is quite high. It has come to our attention that the charge for MY modem is coming from his account, not only that, it is usually more than £15, ranging up to £38. The modem has been broken since Dec 2010 and the bills are still above £15, how can this be if its not in use???
Also the phone contract is supposed to be £45 per month but there is always £65 subscription charge on there?????
The staff in the shops are useless and tell you to phone the call center and the call center tell you that you have to go in store?????
I am totally confused and feel that they just make things up as they go along.
Is there any way of cancelling the Modem contract, is it legal that they can take it from my brother's account??
I would greatly appreciate any advice.
