Hi, Im new to the boards but need help..I lost my mobile recently, i wasnt drunk or putting it in a pint or anything. I tried to find it, tried ringing it but no one answered then it was turned off. I reported it to the police as lost and had the sim and handset blocked as i assume someone has picked it up. Now i have the business of making the claim. The issue is that in the it states that it covers loss but not if it is due to negligence???? When is losing something not negligent in some way???Does anyone have any idea how to word this claim, im only 3 months into an 18 month contract and desperately need this phone replaced!PLEASE HELP!!!!

I mean it says in the Terms and Conditions

  • While it is in an unattended motor vehicle, unless completely hidden from view within a locked glove compartment, locked boot or other lockable internal compartment and the vehicle is fully locked and secure
  • Where it has been left unattended in a public place or place in which people, the public has regular access
  • Where it has been passed to someone else

How can u loose something any other way??? every where u go is potentially classed as a public plaCE??

My insurance is through my bank account, Halifax

Please help!!

Not that I can help you, but all insurance companies are experts in ambiguity and spend more money on finding excuses for not paying than on paying.
...I had my phone stolen from my jeans pocket at a gig in london....

"Your claim has been denied under sections 2, 3 and 10 of your mobile phone insurance contract. We will be writing to you to let you know that your claim has been denied and advise of steps that can be taken if you want to appeal"

    These are sections 2, 3 and 10...

    2. theft of the Gadget from any premises or mode of transport unless involving forcible and violent entry or exit

    3. theft of the Gadget from the person of the user unless involving force or the threat thereof.

    10. loss of the Gadget loss of use or any other costs that are directly or indirectly caused by the event which led to your claim unless specifically stated in this policy

English is not my first language, but IMO "theft ...from the person ... involving force" is robbery, not theft *. Does this mean that in fact the policy covers a robbery only and doesn't cover any theft?

I think at least 90% of all insurance companies specialising on mobiles are thieves steeling money from their customers.

    * I seem to be right: "
Robbery is the crime of taking or attempting to take something of value by force or threat of force and/or by putting the victim in fear..."

After a post comprised of disjointed quotes like that I'm not surprised. :)

Do you still suggest telling the company that it was stolen?

Confusion is a normal state after reading the small print of insurance policies.

I edited my post and divided it into two sections to make it more understandable for those who have problems with linking the quotes together.

Rather than concerning yourself with my own advice, I'd suggest re-editing your post so it is legible enough that it makes some sense to the OP to be honest. :)

Firstly, my first words were: " Not that I can help you...."
Secondly, the post is perfectly legible and makes sense to the OP. His problem was with the ambiguity of the word 'lost'. My post was about a pretty unambiguous word 'theft'. Even this simple word became ambiguous in the small print.

And finally, the OP has not said if it was my post or the small print that caused the confusion.

Also, I have a suggestion too: read the posts before giving any advice.
