Harangued by Three - who want £400 for no service ever used!

I looked at taking out a contract with Three about 3 years ago- I did not take out in the end and cancelled contract on phone but they say they need some more info before cancelling.

I sent phone back to them of which they have no record and now 3 years later they are chasing me for cost of contract and early termination fee - around £400 - for a service which they acknowledge I wanted cancelled, did not want to take out and have never used.

I am disputing with them but obviously they now have a debt company involved. I would liek to say that Id like to take thsi as far as I can as I do feel it is another example of us consumers being bullied into paying for services which we did not even use.

Where I think I may have problems is that although I acknowledged over the phone I wanted to cancel, they are saying they did not get the info from me.

Any thoughts would be appreciated?

    They will keep on harrassing you and they will give up eventually. Does it appear on your credit report? If not I'd ignore it. If it does then you'll have to start writing letters to them to get them to remove it from there.

    They won't bother taking it any further than that so you can ignore it and in the very unlikely event they do take you to court to get a CCJ you can defend it there.

    What you have is a debt problem, not primarily a mobile one.

    So, the debt forum is best to give advice, but in general they need to prove a debt was incurred.

    So you need to dispute the debt by sending the Debt Collectors a letter under the Consumer Credit Act. Take a look here

    Now all they have is an amount that 3 claim you owe, so they can't supply the information you require and they will either refer back to 3 or try to bluff their way through.

    You may have screwed yourself a bit with any communication you had with them already, but try reading up on the thread I gave you.

    They need first of all to prove a debt exists before they dispute whether or not you cancelled and returned the phone. Don't forget to ask for evidence of any calls/texts being made on the mobile number they claim you were allocated.
