o2 express exit fee

Hi Guys,

Hope all is well.

I was with o2 and having fulfilled my 12 month contract with them, I decided to leave. They were aware I was about to leave because I received a call from the sales team trying to offer me a better deal but I told them I will not continue with their services.

I signed onto talk talk, and was well until I received a notice saying I owe o2 £15 for not giving them 7 days notice for cancellation.

What???? They said it's on the contract, but it is ridiculous and I can not believe this rip off as i have already completed the contract and they place a clause, whoever reads them, so they can charge people more.

Any experience of this???

    yes i was with o2 BB and completed my 12 month initial contract aug 08 to aug 09 and stayed with them after that on a month to month basis, but left and 24 months aug. 10(12 months after my contract ended) all fine. then in May 11 i get a phonecall from Fredrickson International to say they were contacting me on behalf of o2 to say i owe them £30 for an early termination fee, which is strange as i left after 24 months a yr after my contract ended. and no contact from aug. 10 until May 11.

    So I presume you paid?

    This is what I managed to find on a 2009 thread:

    "7.4. After the Cooling Off Period, you may terminate your contract:
    (a) by sending us 30 days’ notice in writing via the O2 Broadband customer service email address given on the Contact Us page of
    or to the postal address: O2 Broadband Customer Service, Skypark 4, 8 Elliott Place, Glasgow, G3 8EP. You must pay all
    Charges incurred during the 30 days. If termination is effective within any Minimum Term, you must pay us the monthly subscription charges up to the
    end of that Minimum Term. This does not apply if you end the Agreement for the reasons in paragraph 7.4 (c); or
    (b) by paying an express cancellation fee of £15 and all Charges that would have been incurred during the usual 30-day notice period. If termination
    is effective within any Minimum Term, you must pay us the monthly subscription charges up to the end of that Minimum Term. This does not apply
    if you end the Agreement for the reasons in paragraph 7.4 (c). Service will be terminated usually within four (4) days after receipt of your express
    cancellation notice in writing; or

    7.7. Your request for a MAC key is not deemed to be your notice of termination. However, if the MAC key is used by another broadband provider and if you
    do not provide notice under clause 7.4, the date that the MAC key was used will be taken to be the date that we received your notice of termination under
    clause 7.4(a)."

    Although I did not give my termination of notice:

    a) I spoke to the sales team to say I will not take up their offer and will move:

    b) 7days before termination of line, they were notified by BT of the cancellation of the line........

    :mad: Who reads their contract after it is finished!!!! Not Fair!!!

    no i argued the point as my contract ended 12 months previously. i got an email from their exec dept saying i owed nothing as it was an error on their system, but o2 staff dont acknowledge anything from their own exec dept. they eventually relented and canceled the debt agency and confirmed i owed nothing, but refused to remove a default notice on my credit file, that is until i told them i was going to inform ofcom of this.

    Your contract didn't 'end' 12m earlier. It reached the end of it's minimum term. After that point, it becomes a 30 day rolling contract on which you have to give (no surprise) 30 days notice.
    This is a standard term with virtually every ISP.
    So I'm baffled as to why they withdrew their claim.
    No free lunch, and no free laptop ;)

    In this case the ISP is entirely in the right as macman has already pointed out. If they backed down in some other case it wasn't because they had to and it certainly wouldn't be because of threats to set Ofcom on their case - apart from them being completely toothless this sort of issue isn't even Ofcom's remit - use Otelo instead - http://www.ombudsman-services.org/communications.html
