Parking Fine Help Please

I took my mum shopping today, she has a valid disabled badge so parked in a bay in a car park (sainsburys), went and did some shopping and had something to eat and was gone about 3 hours (she is quite slow and only gets out a couple of times a week so likes to take her time  )
On returning to the car I found we had been issued with a ticket! As we had been over 2 hours. Anyone have any idea if we an appeal ? I always thought disabled badge holders were exempt from the 2 hour thing - they certainly are in council car parks.
Real men never follow instructions; after all they are just the manufacturer's opinion on how to put something together. :p

    Who issued the 'fine'?

Speak to the store manager, I suspect its run by a 3rd party.

Speak to the manager, they will hopefully get the car park company to recind the ticket.
  • Store say it is not their problem, typical huh!
Going to write a letter of appeal and see what they say.
Will they gove me extra time to pay the reduced fee if I appeal? No phone number so impossoble to contact - only an automated line for payment.

Sorry to rain on your parade, but usually being disabled allows you to park in a disabled space, but not to exceed time restrictions. Sainsburys are entitled to set their own rules in any case. However, write to them and they may be sympathetic - unlike councils they have an interest in you remaining good customers and may waive the charge this time.

If only these little hitlers spent more time booking people who are not disabled using these spaces and less time with the people who really need them. Makes me so angry.

Do not pay the fine, it is not enforcible.

"I know about these so called parking enforcers. They ticketed my dad's car in ASDA at Chesser. As a 'legally minded' civil servant I challenged the validity of their enforcement procedures. They were very rude and said they would take him to court under small claims procedures. I wrote to them in legal terms requesting a copy of their agreement between their company and ADSA (as advertised on the ASDA notice board) together with a copy of the Statutory authority under which they had the right to pursue the matter as a civil small claims debt.

    THEY NEVER REPLIED.

I think the company was called Town & Country Parking' or something to that effect"

Other ways round this is to do nothing, you will get a letter in the post demanding the "penalty"
Reply saying that you are the registered owner and was not resposible for parking on the day in question.
If they reply asking for the details of the driver, write the following -

    Dear Sirs

I am unable to provide you with the information you request.

Any further communications from yourself will be taken to be harassment, contrary to section 40 of the Administration of Justice Act 1970, and appropriate action taken

I sincerely hope this will therefore end your fruitless pursuit and futile correspondence

    Yours etc.

Nope, have checked this in council car parks with traffic wardens as it takes too long to get about with my mum and 2 hours would never be enough. Traffic wardens (on a few occasions as always check if I see one before parking) have informed me blue badge holders are exempt from the 2 hour rule.
Should never have assumed it was the same everywhere tbh, but hindsight is a wonderful thing!
Would have been nice if they had maybe issued a warning, then would have known!
Bear in mind too blue badge holders can park on double yellows for 3 hours if need arises.

I’d imagine that this is for very good reason. It would strike me that Town and City Parking’s position probably falls foul of the Disability Discrimination Acts. They don’t seem to have made any “reasonable adjustment” of their two hour limit. You might want to contact the Disability Rights Commission, to see if this is the case.
