3 mobile faulty phone problem

hi,got a blackberry pearl on 18month contract through 3 mobile ,2 months later the micro USB charging port is broken ( it keeps pulling out with the charger) I went to them and they said I have to pay to get it repaired
how do I stand legally as it's faulty,surely i should not have to pay to repair it ,not under six months surely..................please help if you can
ps i got it from a 3 shop,not online

Sale of Goods Act applies. Under 6 months old it is deemed faulty in manufacture and the onus is on the retailer to repair or replace. Your contract is also with 3, not Blackberry, so it is 3 who have to resolve this - don't accept being fobbed off and told to go to Blackberry.0

That's a slightly simplistic description of the situation.
The retailer is able to examine the goods and if they can prove the problem was caused after purchase then they do not need to offer a remedy.
So in your case, it sounds like 3 are claiming that the handset was accidentally damaged.0 -

99% of the time for a charger port it's down to excessive user force, either inserting the plug or yanking it free.
On one hand the law states anything under 6 months is usually deemed a manufactring fault, however the law does not cover user damage. You'll have an uphill battle saying this is not user damaged though.
Sorry it's probably not what you want to hear.0
