oh the joys tax credits

hiya

this is my first post here but i have had a "wonder round".

i have just had a letter from the tax credits dated last week asking for a over payment. nothing major you may think but it says for the tax yr ending APRIL 2007!!! we have had tax credits since 2008 continuesly so why have the waited till now to ask for this money? we also had tax credits for 9 weeks in 2006.

can they ask for money from 2007 in 2011?

    We are paying back an overpayment from 2004 which they found in 2009 so I would say yes.The system is not fit for purpose and the sooner they are scrapped completely the better.........

    It depends - what was the reason for the overpayment? If it was their fault and you provided all the correct information I don't think they can suddenly demand the overpayment back now. But if it was down to fraud or neglect on your part they have up to 5 years.

    i called them this am and they would not tell me why they are asking now and could not tell me why i have to pay it back, reconed they had sent me letter (i keep EVERYTHING i have ever had from them since 2006!) they sending me out a dispute form to fill in and send back

    Around the time of your overpayment, did you change circumstances - ie, change from a single to a joint claim/joint to a single claim? If you have, then this is why they are chasing you for a repayment rather than just deducting it off of your subsequent awards. On your award notice from that time, did it state that there was an overpayment?
    They will normally just claw back an overpayment from future awards, but, if it has been closed and a new one created, then they cannot recover from the new award - and it can take time for them to catch up with you for the payment.

    i am not sure as i cant remeber i know after 9 weeks in 06 we were no longer entitled to either tax credits (took awhile to sort out) but then in 08 we had our daughter we were eligable again.

    p.s how would we know if a award was closed etc as i cant remeber
