15 year old claim- Please say yes....

    Give FOS a ring and tell them welcome are being obstructive with the insurer details and ask if they can help.

    Thank you Amersall. Contacted FOS, they were really, really helpful. They have registered my details and suggested that I write to Welcome to obtain the insurers details, then to contact the insurers with regards my claim. If I have any problems whatsoever then I am to contact FOS again and they will follow up.

    I think you are unlikely to succeed Calum.

    Aviva can simply point to the fact that Welcome was not its representative and it is therefore not responsible for its actions.

    Welcome no longer exists and complaints against intermdiaries relating to events prior to 14 January 2006 are not covered by the Financial Services Compensation Scheme.

    Even if they had remained in existence, FOS had no jurisdiction over its activities prior to the launch of the GISC code in 2001 and this was sold in 1992.

    Your last recourse would be the courts but Section 14B of the Limitation Act 1980 would prevent you from taking action in respect of something that occurred more than 15 years ago.

    Sorry - I know that is not what you want to hear but that is the reality, I'm afraid.

    But FOS are accepting complaints against insurers aren't they? Also what about section 32 Limitations act?

    Well, it took ages, but £1756 returned to me, plus 8% interest of £1532 (will have to pay tax on that though)

    Almost enough to clear my Visas and make all of my monthly pay my own and not the credit card companies!!!

    Nearly 15 years old this claim i think, so it is worth it if you still have the paperwork.
