Employer got pay wrong, how will LHA be affected?

My employer got April's pay wrong due to not paying me the correct level of sick pay. I have sent April's payslip into the council (they are requesting them monthly at present) but this shows an amount roughly half what it should be. My employer has confirmed today that the pay was incorrect, and that it will be rectified and paid along with May's pay. Therefore when I get May's payslip, it will show May's normal pay plus backpay owed from April, giving me a higher than normal pay for the month.

How will the council calculate the LHA and CTB entitlement over these 2 months? Can I ask them to average the 2 payslips out to try and minimise the under/overpayment effect?

    Yes you can ask them. Write a letter with your payslip detailing the issue.

    Thanks - I just know what will happen otherwise. They'll underpay me, then I'll have a huge overpayment to pay back when they recalculate it, when really over the course of the 2 months in question I won't earn any different to what I would normally had they got my pay right!

    You could also get your employer to write a letter confirming what you say.

    Hmmmm ... they still haven't written to me to confirm my maternity arrangements even though they were notified almost 2 months ago and are supposed to do it within 28 days, so I'm not sure that will be forthcoming ;)

    You could also contact your council now and ask them to suspend your claim, or to use your March payslip on a provisional basis if that is more likely to be your normal wage.
    I currently manage a Housing Benefit service and have been working in Housing / council tax benefit (as was) since 2001.

    I can just see this ending up a complete mess :o

    I'll try and contact them. I can't get down to the office at the moment because my pregnancy complications (hence the reason for being on sick) mean I can't walk more than a few steps (SPD) :o

    For the last couple of months my income has changed by a few pence and they've sent reams of paper in the post to recover an 8p overpayment. It just seems so silly to go through it all again over an error completely out of my control :(

    I can see why you would be concerned. I would say that I think my plan would only work if you got a good assessor who was on the ball ( would like to say like myself but would my head fit through my front door!)

    I only know that this has worked in some cases I have dealt with! Hope you get it sorted in any case!

    If they don't average it, and I end up with an overpayment, do you think I could appeal the decision and ask to have it looked at again by someone else. Just thinking that if some of it depends on whether you get a good assessor or not, if I appealed and it went to someone else they might well agree.

    Oh I understand that one. New year new tax rules. I've had 3 cheques so far since April and they are all different and the next one will be different too. All rounded to nearest pound I've had £178 (last years normal payment finishing in March), then £179, £181, £183 and next time it should be £182 and stay there until circumstances change again.
