thanks all, have spoket to the policeman he said if i can get the letter that stats i was insured at the time of getting arrested he will contact ticket office and get the penalty notice withdrawn (this letter better hurry up) as with regard to no licence he has checked on his system and is willing to let that go as long as i get another one asap,
they did not take the car they allowed me to park it and the owner picked it up later

i must say the policeman has been very helpfull and understanding

    r.

I am assuming you mean at the time of getting stopped, not arrested?

He wasnt saying he would allow her to continue driving that vehicle. What he was saying was that in that hypothetical situation, he could have resolved the matter by giving the keys back to the daughter who is insured on said vehicle and only let the 102 year old drive her own vehicle. Still dealing with the no insurance issue by FPN or summons.

Nah, it depends on the policy, some DOC cover requires the other car to have insurance, other don't

As always, read the small print
Best bit of advice going, dont just assume your fully comp insurance covers you!

Agreed, but its the exception to the rule and doesnt happen very often lol

It may take an hour for a seized vehicle to be recovered. The Police would have to wait with it to hand over the keys.
At 3am on a Sunday morning I can see officers giving people the benefit of the doubt rather than risk being tied up at what might be a very busy time.

I thought you had to go to court for no Insurance.

As it then gives you the chance to prove that you did have it, as you wouldn't usually have your other cars Insurance cert on you when driving the other car on your 3rd party entitlement.

Was your friends car actually insured?

I think it is getting more common that Insurance companies remove the driving other cars cover, hence why I always check when ever I renew my Insurance. A mate had it removed on renewal and they never told him, I mentioned the current habit for removing it on renewal and he checked, annoying as he had to put his name down as a named driver on his other halfs car because of this as he fairly often drove their car to the park with the dogs.

They didn't say let them drive, just that they wouldn't seize it.

These are two completely different things.

The only reason for impounding a car is to prevent further offences, if the car is fully insured then the chances are that most coppers would allow the vehicle to be collected from the side of the road by an insured driver.

This is called discretion, they don't need to cost somebody an extra £500, they can chose other options.

No, it can be dealt with by way of FPN.

Court is only normal if you appeal, the officer chooses to summons, or the driver already has 6 points and issuing a FPN would put them at the limit for disqualification, then summons/court is the only option.
