PCN: Oldham Council

Hi I got issued a parking charce today and was appealing it. Basically half the road is free 30min parking and the other half is disabled parking. I bumped into a warden eho said because my car is over 50% towards the disabled bit its a fine. I've uploaded my photo's to flickr

Wondering what people thought about my chances. I appealing on the grounds of poor markings

    Mmm cobbles! Not very clear from your pics. I'm assuming that yours is the black car? If so, it clearly is on the disabled side of the sign. As for the road markings, your pics do suggest there may be problems with them. We would need the location so we can see the layout on street view plus some wider angled up to date pics of the markings.

    Your chances of appealing a Council ticket successfully are always pretty high if you know what to appeal on and are prepared to take it as far as an adjudicator.

    If your car was only overhanging the disabled side a little then you can argue 'de minimis' (a mere trifle that the law should not be concerned with). It's not clear to me which is your car? But the lines are unclear, I agree with you on that. And there may be flaws with the PCN and with the Traffic Order for that street as well.

    First, you need to post pics of the PCN (front and back) and these pics of your car, on pepipoo forums here (it's free and they are the experts on getting off PCNs):

    ...and meanwhile email the Council for the Traffic Order for that street, or call in to the main Council Offices to get a copy (for less than 50p I think). They cannot refuse or overly delay producing it, or tell you to make an appointment, it's a public document.

    Do not miss your appeal deadline waiting for the Order (and do not mention the PCN number or your full details when requesting it in case the request is taken as your appeal). Maybe a relative could email for the Order as any 'interested person' has the right to see it. Then ask pepipoo how to add the Order link to your thread, as there may be flaws there too.

    Makes you wonder what they have to hide. I always thought, as it is a public document, that they could only charge 10p per sheet for copying.

    Hi,

    I would like to lodge an appeal regarding the above penalty charge notice. As the photo's above show the road markings are very unclear and make it very had to determine which part of the road is disabled and which part is the thirty minutes free. There is no obvious yellow or blue lines to distinguish disabled parking from normal.

    This is my first ever parking offence and I am a careful and considerate driver and would never deliberately occupy a disabled space. This was simply a matter of confusion over which side of the road was disabled. Any leniency you could show would be very much appreciated.

    Hi, Does Any know what are the guild lines and regulations that Traffic Wardens (In OLDHAM) must Follow before they are allowed to Issue and Parking Charge Notice?

    As I have received a PCN and a Photgraph of My Vehicle parked on double yellow however there is no Ticket PCN on the Vehicle?
