dla turned down- please help

Hi,

I am shocked that I have been turned down! I was on high mob and mid care. I have sle, sjogrens, fibro- I cannot get out of bed easily ad am in constant pain. I am on morphine-butrans- patches. My eys are blurred alot of the times and I have tripped and burnt myself because of it.

I am going to appeal but can someone give me advice. I phoned them and am waiting for the letter.

I am on my own with my 6 yr old and have no close people to help me. If anyone is near the sw14 area and is kind enough to help I would appreciate it. I am terrified as I am so weak and so exhausted.

    assuming you have been a victim of atos if i were you i would first telephone the DWP and make an official complaint against ATOS regarding your treatment by them, then phone your local mp and make an appointment telling them about your official complaint, itll take ten mins and two phone calls, you would be amazed at how quickly the DWP can do things when you get your mp involved, good luck, try not to get to down about it as this seems to be happening to everybody atm and not just you

    I filled in the form from advice on the 'benefits and work'. I did not have an atos medical. I have spoken to my local social services as they initially told me to apply for it. They have put me in touch with with a local disability helpline who have a 99% success rate and told me not to worry and that the governmnt are doing this hoping people won't appeal so they can save money. Let me keep my fingers crossed... x

    You were on High Rate Mobility and Middle Rate Care, and then got turned down at renewal time - is that correct?

    have you asked for a reconsideration?
  • The first thing you must do is ask them for a "statement of reasons"this will incease the time you have to lodge an appeal from 4 weeks to 6 and help anyone from disability/welfare rights in the appeal process,once the appeal is lodged the decision will be reconsidered i.e. looked at by a different decision maker who may change the decision,or you may have to go to full appeal,make sure you go for an"oral"appeal"not a written one as it stands more chance of success.

    If for some reason the local "disability helpline cant be of assistance then see if theres a branch of D I A L covering your area,or if your local council has a welfare rights dept,as a last resort CAB(i say last resort as they are often too busy to be much help).

    That can be time wasting as an appeal includes a reconsideration,better to go straight to appeal

    Thank you everyone. I have just had a call from DIAL and am seeing them on Friday. They seem confident that I will get the same amount and are horrified considering what I had before. They mentioned about phoned dla while I was there so I am not sure what they will do untilI see them.

    I get a low amount of direct payments from ss and they (ss) reduced it when the new government came in saying that my dla had to cover some of what I was getting. SS told me that I should get dla and referred me to dial. They don't make the decision but if they have a 99% success rate I have some hope. My illness has got much worse so I did expect to remain on what I had.

    With the sound of what was happening, they are taking the overflow off CAB. They themselves will now be under pressure as is CAB.

    I cant see that anyone has suggested that DIAL make decisions?

    you say you ask for help with something that wasnt "that"important,perhaps why you didnt get their undivided attention?
