basically we have been getting by on as little at £30 a week for food some weeks, i have had no car for the past few months as it failed its mot and i couldnt afford the repairs, we are literally scraping by each week i have not been spending the 'reccomended' amount on things like clothes and food simply because we couldnt afford to

If that is the case , you will not be able to go br as your outgoings exceed your income by a large amount.

It's more a case of if the OP goes BR then they need to reassess their expenditure and cut back.

In that case I would not stay in the IVA.

With regards to the car, if it is SORN at the date of your BR order, the OR is highly likely to take this (by it being SORN you have in effect proved it's not needed will be the argument, thereby freeing up those allowances on your SOA).

If it is repaired before you go BR, you would need to prove that it was essential for getting to and from work, health reasons, etc.

If you are in an IVA and sometimes living on £30 a week why have you renewed your gym membership?

    sorry for the late reply

the car is getting repaired sometime next week but it is being paid for by a family member as i need the car to get the children to and from school, atm i am relying on grandparents taking the children to school. its not currently SORN has tax just no mot until the repairs are done.

If you are using the car for school journey's I don't think that the OR will allow you the allowances for the car.
So is it worth getting repaired?

but without the car i couldn't get my children to and from school, i couldn't do the food and grocery shopping and when i do return to work when the youngest is at school i then wouldn't be able to get there lol

Children to and from school and grocery shopping may not be enough reason to keep the car (especially if you are close to a bus route, etc). Planning to return to work in the future won't be taken into account either unless this is due to happen in the next few weeks.

You do need to build a stronger argument for the vehicle.

Hmmm maybe this BR thing isnt the best for us then,

i could not manage without the car, having to rely on lifts at the moment is a nightmare as it is, there is a bus route on our route but to get to where we need to be it would be a bus into town center then a bus out, i would be in effect going on 8 buses a day and the same for groceries that would be a bus into town and a bus out of town to the supermarket.

Maybe we just need to manage money better and now 'hopefully' they have reduced the IVA payments so we can budget a bit better and hopefully get some of the extra bills that have accumulated in recent months paid off!
