    You can rest your case all you want. However, you are totally wrong. Let's start with a basic definition of fraud:

    "Obtaining pecuniary advantage by deception".

    One final point: If it were fraud, why do you think Tesco hasn't called in the police? I can tell you why - no crime has been committed by the customer. The only criminal here is Tesco.

    (By the way, it's "Defamation", not "Deformation".)

    If the retailer cares so much about their customers and not about making obscene profits why don't they make the effort to get the advertising correct in the first place so that customers are not taken advantage of?

    Why would anyone point it out when Tesco's policy actively encourages people to allow themselves to be overcharged in order to claim a full refund? There is more than one way to skin a cat, you know.



    Do you point out misprices, or do you buy the item and claim a refund as per Tesco's policy?

    I know, I know...but I felt it was about time the fraud debate was posted here (from a proper legal perspective) due to all the newbies about. We wouldn't want them frightened off by all this talk of fraud, etc. Better to make one clear post on the legal position here than stick it in the Ethics thread which most newbies won't read.

    Then why not do what you do best and go and r&r some more., anyone know where the nearest store to Whaplode is?
  • i tried getting a tesco mobile today with the offer of "spend £40 or more and get £20 off" however the woman at the till discounted it manually. :(

    it deff doesnt do it automaticaly at the till though. just to back that up i heard a couple of women employees !!!!!ing about the fact it wasnt doing it automaticaly. :D

    Hi

    Today I brought a sony ericsson W810i SEL stated £169.97 or £147.97 if £40 spent instore. Definate R + R customer services said I will refund £2. I pointed out there policy still would not budge. Shall ring customer services tomorrow morning. They would not let me keep the label so I do not think I can do anymore until tomorrow but will e-mail them now.

    Could I have done anything else

    the only snakes round here are on a plane on a dvd on a shelf in my lounge!!!
