    Airbags deployed and new doors would worry me a lot, unless it was some unfortunate deployment due to a runaway shopping trolley (joke). In your shoes I'd be chasing a refund I think, but on the whole, Cat D's wouldn't bother me much as insurers are fairly quick to write off as a Cat C anything that's remotely dangerous (due to VIC check).

    My current car was a CAT D when I bought it about 18 months ago. Cost me £1,600 plus another £1,500 to get it on the road, comparible cars (not CAT D) were being advertised on Autotrader for about £1,500-£2,000 more than that. It's been fine since I bought it and done over 50k miles since, the damage was cosmetic, needed a new bumper, wing and a door plus a few other MOT related items. Of course it does affect the resale value, but I intend running mine into the ground so no worries there personally.

    ok RS Trade Cars Ltd, of church street in armthorpe have just confirmed that they won't be giving me a refund.


    the owner, russell has declared that the car was priced to sell and the words HPI clear weren't mentioned in the advert and that he had no legal obligation to inform me of this.

    as for the faults he insists that i would have to take the car down to him and have his specialist take a look, a process that would leave me without a car for a week.

    I don't thing that you can really complain that they will sort out the faults themselves, what are the faults?

    Ticked all the boxes here, we have the cat d, the faults and the miss description re parking sensors

    If you are sure that you don’t want the car because of the cat d status then send him an email, include the link from above where a dealer was prosecuted by trading standards for exactly what he has done and tell him that unless the car is collected and a full refund given within 48 hours then you will contact trading standards with a view to getting him prosecuted as well as taking court action to recover your money.

    The faults are a Sale of Goods issue and the legislation is perfectly clear, any faults have to be repaired without significant expense or inconvenience to the buyer. Expecting you to deliver it a 100 miles plus and leave it there for a week is ridiculous so either they need to get the faults repaired local to you or they need to provide a replacement car. I’d also say they need to cover your travelling costs if you do take it back.

    The lack of parking sensors is a tricky one, it could be you would not even have considered the car without parking sensors then it would be reasonable for you to reject it and get a refund. If you would have gone for it anyway and the sensors are just a nice extra then maybe an adjustment to the price to reflect the reduced valve would be more appropriate.

    Personally, with the level of customer service they have exhibited I’d be doing everything I could to get my money back.
