    Thought I'd update on our house search - we have found a private landlord who I was totally upfront with and he was fine the looming bankruptcy - only issue is his house which is lovely is a bit too far away from family who are very supportive of our situation but very sad that we may move further away which ups the ante guilt wise. I am the only driver in our house - my car is only worth about £1200 but I think as I don't work the OR will want to take it off me - I home educate two of my children and as there are 5 children it would cost more to use public transport for all of us so maybe I could argue my case?
    I only sleep two hours a night at the moment - happily my breast cancer tests were ok so I am thanking my lucky stars I don't have taht to deal with but I go through absolute despair desperately trying to find a way to avoid bankruptcy. Like you we don't like our house and associate it with debt so don't mind moving but the rental is proving a nightmare. We viewed a 3 bed yesterday via letting agent and it was so small there was no way 7 people could fit even if we ditched all unecessary furniture etc. Stopped the dmp payment and the mortgage yesterday so we need to press on and stay strong!

    Thanks for your post Maizy - I know we are doing the right thing - it that time in the middle of the middle of the night that the doubts start to creep in. It's a good job forums like this are here to get some support and it really helps reading about other people going through the same thing - not that I would wish this on anybody

    thought I would add some of my experiences - they might help

    First - big hugs - these are very important - and are free!!! lol

    Ok - firstly re-secured loan(SL)
    We contacted SL explained situation and they lifted their charge on our property thus allowing us to sell for bare bones - this loan became un-secured when the house was repossesed - which brings me to next stage

    House - As soon as mortgage company got wind that loan company had lifted charge they slapped a notice on the window of the house to inform us they were taking possession and would be changing locks in 14days - we moved - and they did EXACTLY what they said they would!!!

    Renting - we were up-front - managed to rent a church property with 3 dogs and 2 cats - have been here for 3yrs now - licking the wounds of our previous life - wish we'd moved sooner

    BR - not quite got there - still struggling to fill in the forms - only because everytime we try I suffer a panic attack, and suicidal depression - stupid I know - all the above was by far the worst thing EVER, but I still fear the unknown - and can't face going over all previous stuff again - life since we moved has been OK - we have nothing - but also have no "new"debts - everything is paid in full and on time - and we eat proper food !!! - not the thrown together slop we were having before losing our home

    However still got to face the final hurdle - and soon - cos this week mortgage company finally contacted us re-short fall and at 31k got no choice but to go BR - thinking of contacting christians against poverty as need "hands" on help - to cope mentally

    Good question.

    It seems council tax from previous financial years can be included in bankruptcy, but you must pay the current financial year, ie, from April.

    But, council tax from previous residences is allowable, so if on the day you are in court, you are living in your next house, then council tax on your present one can be included in your bankruptcy.

    That's one interpretation, anyway.

    In your circumstances I would be inclined not to pay it.

    There must be plenty of people who pitch up at court/do their OR interview showing arrears from a previous property, so I'm sure you will be put right at one stage or the other.
