sold car ,awaiting v5 document

hi please could someone on here help . we have sold our car but the man wants to take it tomorrow, but we are awaiting V5 document as we had private plates on it , we have received the tax and MOT with old registration on to give to him. if we write out a receipt saying we are not liable for any offences or incidents from when it leaves tomorrow does this cover us. V5 document should be here within the next week or do we have to wait for that to come before the car goes.

    Depends if he is legit. If its someone who has no insurance and plans to do dodgy deeds he will probably
    leave false details anyway.

    You send the V5 back anyway so a few extra days wont make any difference. Is the buyer happy to buy without
    a V5? I wouldnt.

    yes he is ok about it,as he known us for last 10 years. he has paid us in full aswell

    I'm sure your arrangement will be fine. The buyer is taking the biggest risk buying the car without the V5C logbook, but as he knows you personally I'm sure he's already taken that into consideration.

    There is no reason legally why the buyer can't take the car and drive it even though he doesn't yet have the V5C. Just remember to back-date the change of keeper details when you complete the new keeper section on the V5C and make sure you send it off to DVLA straight away.

    Also make sure that you receive confirmation of the change of keeper details and hang onto it as it's your only proof that you are no longer the registered keeper that the DVLA will believe. If you don't receive it after 4 weeks of sending it off then call and write to them to chase it up.

    The transfer process clearly states :
    What happens next

    The DVLA local office may need to inspect both vehicles and will contact you to arrange an appointment. If they don’t need to inspect, they’ll approve your application within two weeks.
    On approving your application, the DVLA local office will send you:
    • a confirmation letter to advise the replacement registration number
    • new tax discs for both vehicles showing the new and replacement registration numbers
    • an authorisation letter (V948) to get your number plates made up
    Allow at least two weeks, after sending your application, before contacting DVLA customer enquiries if you don’t receive these documents.
    DVLA, Swansea will send new registration certificates for both vehicles showing the new and replacement registration numbers. These should arrive within four weeks of the confirmation letter. It can take up to six weeks if a V62 application was used to support the application.
    You must not sell or get rid of your vehicle until you receive a new registration certificate, as the new keeper will be entitled to keep the registration number if they want to.
    As the registered keeper you are responsible for informing your insurance provider of your new registration number.

    I can assure you that if your vehicle was going to be inspected by DVLA, you wouldn't have already received the replacement tax disc and MOT certificate.

    The formalities have all been completed, you are simply waiting for DVLA Swansea to reprint the V5C and post it to you.

    Just a point, it is now possible to retain a private number plate at the same time as notifying DVLA of the change of keeper. The form V317 was changed to allow the Grantee information to be included.

    The old rules stated that only the registered keeper of a vehicle could retain a personalised registration as the Grantee.

    The old rules stated that only the registered keeper of a vehicle could retain a personalised registration as the Grantee.

    This "new" V317 document still retains the condition of not selling before you receive the new replacement V5C.

    So, although DVLA have attempted to update the process to allow transfers at the same time as a change of keeper, as usual, they have not done a complete job of changing the appropriate forms to make the process clear and unambiguous.
    In my opinion, the V5C needs an additional section that the keeper can sign to show that a V317 form has also been completed to retain / transfer the registration number. This would close the documentary loop to show what should happen with the registration documents.

    You are absolutely right. Once again it is a case of DVLA introducing a new procedure without fully thinking it through.

    The one that really annoys the motor trade is when a number plate is transferred or retained and at the same time the yellow slip is completed to notify DVLA that the vehicle has been sold to a motor trader. DVLA cannot issue a replacement V5C as there isn't a current keeper!

    The motor trader has a perfectly legitimate vehicle for which he/she cannot have a V5C log-book. This puts off a lot of potential purchasers and means either the motor trader or the new purchaser has to pay £25 to DVLA to have a new V5C issued in their name. Ridiculous.

    Yep...that is why I always put my registration on retention a few months prior to wanting to change my car. That way, I know I have the new V5C with a normal reg number when it is time to sell.

    The only drawback is I have to pay for new number plates and get a new insurance certificate, but it is a small price to pay to make the process run smoothly.
