Vodafone contract cancellation question

After losing his phone on Sunday, my OH went into Vodafone (store) and got a new phone on a 24 month contract on Monday.

Yesterday he took the phone back and exchanged it as it was faulty. No problems.

Today, after dialling 44555 and seeing they are charging him for data usage he called them up and they said they could bar the data usage, but that would mean he couldn't send picture messages either.

Unhappy with all the faffing about, he took the phone back to the shop and asked for the contract to be cancelled and the phone returned.

The guy in the shop had no problems with this and did all the paperwork.

My OH is now trying to get a PAC code to go back to o2 (after getting a PAC code to go to Vodafone), and now it seems Vodafone are getting messy with him. He's getting conflicting information regarding the contract.

1st advisor said he is liable for the whole 24 months line rental.

2nd advisor said he would be liable for an undetermined cancellation fee.

Now, I understand that returning a phone to a shop is down to the discretion of the individual store manager, but what about the actual contract?

Does the 7 day cooling off period apply? Is there a cancellation fee, and if so, how much?

Naturally, he expects to pay for the value of the calls and texts he has made on the new phone, but beyond that we can't get a straight answer from a call centre agent, and any written communication could be a week away at best due to the long weekend coming up.

Any advice from a Voda rep or anyone with experience with similar would be gratefully received.
Remember this: nothing worth doing is easy.
