    no but they would get the dis prem and sdp paid with jsa both can still be paid with jsa found this link about claiming jsa and being disabled.

    So you think that someone can go from ESA to JSA and then claim the Disability Premium with their JSA as they get DLA?

    that is correct the dla middle care gives accsess to the premiums all the threads last winter for cold weather payments related to is jsa with a disability premiun etc

    The part that I am not sure about is the going from ESA (with no disability premium) to JSA ( with a disability premium) I would have thought they would not pay this.

    I'm pretty sure richard9991 is correct - it's another anomaly in the system that has not been ironed out (along with the ability to claim ESA pretty much continuously, however often you fail the WCA!).
    Gone ... or have I?

    dont see how they could not if the rules for jsa say you get the premiums ie dis prem sdp and enhanced if on high care. a better link below a few years old but the rules havent changed

    Yes I can see that being sorted out sooner or later.

    You may well be right Richard. I hadn't noted OP was getting DLA.
    I currently manage a Housing Benefit service and have been working in Housing / council tax benefit (as was) since 2001.

    the original plan was that the transitional relief would last till 2020,not sure if thats still the case but havent seen anything yet to suggest its not

    THEY ARE ONLY PAYABLE WITH INCOME RELATED ESA - NOT CONTRIBUTIONS BASED ESA

    I've been on Contributions based ESA since Oct 2008 and was placed in the Support Group almost immediately.

    If the OP has been on IB for a long time they may find their NI contributions are too low for Contributions based ESA and therefore they'd automatically be processed for Income Related but this is dependant on HOUSEHOLD INCOME.

    The Benefits helpline would be a good source of information regarding differences in current IB income to ESA.

    Also ALL ESA CLAIMAINTS SHOULD REQUEST BACKDATED PAYMENT ONCE ASSESSMENT PHASE IS COMPLETE.

    I had my Support Group rate backdated to the 1st day as I'd been off sick for 28 weeks.

    all ib claimants know matter how long they have been in ib if they pass the wca will be placed on esa cont this link is long but it states the above also ppl on sda will go on to cont esa ppl on income support will go on to ib esa
