Sending letters to DCA's.. advice please?

Just a quickie... after recieving a letter yesterday from a DCA about a debt that DH believes was from when he was 18 (10 yrs ago) we obviously need to send them the letter about it being statute barred etc but do you send the letter asking for the original credit agreement first before sending them the letter saying it's statutue barred or do you just go straight in for that instead of asking for the agreement?
Also does it matter if the letter is handwritten or printed as our printer is broken and it's not the kind of letter you can ask your mates to print out for you really!

    Just send them the letter, whether hand written or printed. Have you got a copy of the template letter? If not, a good one can be found on post 2 of the following thread:

  • I would send one not aknowledging the debt and add something about debts being statute barred.

    But surely if you say that the debt is statute barred it implies that you know about the debt and how old it is.. so could be seen as a form of acknowledgment?

    I wouldn't have thought so. You just send the letter stating that you do not acknowledge the debt and then also mention that it has been more than 6 years anyway which means the debt is statute barred.

    I do wonder though if you ask for a copy of the original agreement, if this would not cause you more hassle? .... What if they can provide it? .... This could be seen as proof that you do owe the debt. But then again, thinking about it, even if you do owe the debt, as we have already said, it is statute barred anyway.

    Not true i_e - the first line of the template letter states 'No debt is acknowledged to you'

  • Hmmm.. would it be an idea to get his credit reports first and see if it's on there? But I presume if it is statute barred it would have dropped off by now...??? Or should we just go ahead and send the letter?

    Dare I say it, but would ignoring them just be an option too?

    The debt is statute barred so they could take no further action. Although I suppose if they start 'nagging' the heck out of you about it then it would become quite annoying.

    Just ignore me lol .... providing contridictary advice to day :)

    Well I suppose we could as the letter as sent to Dh's old address but would rather just get it sorted as you know full well it'd keep coming back to haunt us..
