MoreThan/Cavalier Carpets

Hi all

I am looking for some advice please. I have recently had to make an insurance claim for a burned carpet. To cut a long (very long) story short, I was unhappy with the goods I was being supplied on my claim. I believe that the goods that are being supplied are nowhere near the value of my claim.

I asked if I could have a cash settlement instead and was told yes but I would have to pay a cancellation fee to the supplier which was almost as much as the actual claim.

I looked through my contract and there is no cancellation policy on it. The company also did not issue me with a "Notice of Right to Cancel". I believe that this contract is unenforceable and I should not have to pay this cancellation fee.

Can anybody tell me if this is correct or not?

All your help is very much appreciated, this dispute has now been going on for 6 weeks.

  • I too recently had an insurance claim for a replacement carpet damaged by a leak from my radiator. I ordered a replacement carpet through Cavalier after their contractor had visited. I chose to decorate and after I had decorated the wife decided she wanted to change her mind and change the colour of the carpet which had already been ordered and was in stock. When I visited the contractor to discuss cancelling, I was told that I would have to pay cancellation fees. When I contested this, Cavalier kindly sent me a copy of the paperwork that I had signed which clearly stated that I would be liable for cancellation charges if I cancelled the order. I must admit, I never read the paperwork when signing it although I was asked to by the contractor before I signed, big mistake on my part. I actually found Cavalier and the contractor very helpful and accept I made a mistake not reading the paperwork that I was asked to sign. Both Cavalier and the contractor in my opinion would be very highly recommended - they were both patient and helpful in dealing with my claim and although I had to pay an additional £150.00 because of the cancelled order the service was good
