Not only is this nonsense - JL could sell the replacement device to someone else - but I rather doubt that there is anything in law that requires a customer to consider the effect a refund might have on a store's profits.
No your reply is nonsense, unless you are going to go into JL and buy an IPad ONE for the same price as you could an IPad 2 - remember, JL got retail price for the IP1 and would refund retail price on the IP1 - but the IP1 is now retailling for £100 less than prior to the IP2 launch, therefore unless they find an oblivious idiot (I don't deny they might) the likelihood here is they lose money as the product is worth less than originally sold...
As for the comment about profit, of course there isn't in law, but as a business, I would want to keep hold of as much of the money as I could to ensure I stay afloat, as long as thats within the laws then no issue.

The replacement device would have been a refurb from Apple. Apple will send it to JL, who will add it into stock and sell at a reduced price. If it was £429, I expect it was a 16GB 3G or a 32gb wifi model, which will be marked down to £360 or thereabouts to sell.
Good luck finding an Ipad 2 of the same spec in stock for that sort of price though for a while though. They'll be out of stock for at least 2 weeks.0
