Have I been caught speeding or not?

I'm a little unsure whether I have been caught speeding or not. Basically:
-It was on a 60mph limit wide lane single carriageway (A46)
-The camera in question was a mobile speed camera van (facing the opposite direction I was going)
-I'm fairly sure I wasn't doing more than 65, absolutely positive it wasn't more than 70.
-I was overtaking at the time I passed the speed camera van as two cars in front of me were doing around 35-40 mph. I also made sure to overtake only when the road markings indicating that I could.
I know the cameras in the vans don't flash, so I have no idea if I'll be getting a fine through the post or not! How much leeway to speed cameras allow and does the fact that I was overtaking slow moving vehicles (yes, it was safe to do so, I checked before I overtook) make any difference?
If I do get a fine, how long does it usually take them to send one?

Well you will find out within two weeks otherwise the speeding fine cannot be given, speedos generally are about 5% off, plus in some areas they give you 10% plus a few miles an hour, but they are trying to fill a gap in funding so it could be likely that if you were doing 70 you will get a fine in the post.Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!

speed limit is i assume 60 mph .
therefore you are unlikely to get NIP for anything under 66mph .
and your speedo is probably set under what your actual speed is . if you have a sat nav see what speed that says you are travelling . to get to 70 mph on my Sat nav i have be doing 78mph on my Speedo .
Overtaking is not a valid excuse for speeding though .
They have 14 days to send you a NIP , if you haven't had a letter within around 18 days ( take into account upcoming Bank holidays) then forget the whole thing .though to be honest it sounds to me like you have not actual speeded .
if you do get a NIP , there is fair chance you will get offered a speed awareness course . if not then 3 points and standard fine at worse .Better in my pocket than theirs :rotfl:0 -

If you could see the Van then he could probably clock you speeding . But it depends where the camera operator has his camera lined up on .
Just wait and see if anything drops through the letterbox , IF ( big IF, if you ask me ,based on what you have told us ) anything does then see if you get a speed awareness course .
you can get advice on Pepipoo IF you get a NIP . though like i said , i doubt you have actually committed a offence .

You were overtaking so they'd have targeted your car for sure, at 65 I wouldn't expect a NIP as 65 in one car can be 60 in another (going to extremes). Most cars over read the speed slightly.....

They have 14 days from the date of the offence. Bank holidays do not allow for extra time for service. If it's outside the time limit, it has not been correctly served, and the OP has grounds to fight the NIP.
OP, if you do receive a NIP, keep everything, including the envelope and then post again.0 -

i thought they could factor in lost postage days , so they could send it within 14 days but you could not contest if you got it say after Xmas cause there was no post .

The Highway Code actually says in point 139. Overtake only when it is safe to do so. You should ....
- move quickly past the vehicle you are overtaking, once you have started to overtake.
