Advice on golf clubs/my rights

Purchased OH some golf clubs as an early birthday present on 21st Feb, they came on the 22nd I think.

He had only used them about 3 times when he went for a golf session on his birthday (11th April) when the the head of the 6 iron snapped off the shaft, contacted them by email, no reply so phoned up on the 13th, they asked for pictures to be emailed, so we sent some in, then an email back on the 18th saying:

"I have forwarded the photos to our supplier who should get back to me tomorrow. We no longer have this item in stock so cannot send a replacement from here. I have asked whether they can do this but if they cannot then it may just have to be a refund. I will keep you informed as soon as I hear back"

Haven't heard anything yet.

He went golfing again today (minus the 6 iron) came back rather unhappy as there has now appeared a huge crack on the driver (the actual head).

He said he wants to return the full set as he feels he is just waiting for them to all break.

Their website says:

What is the warranty on your products?

***** warranties its clubs to be free from defects in materials and workmanship for one year from sale. At *****'s option and as the purchaser's sole remedy, defective products covered by this limited warranty will be either repaired or replaced at no charge to the purchaser. Such defective products should be authorized for return from *****. This warranty does not apply to normal wear or damage from abnormal use, misuse, abuse, neglect or accident to products which have been repaired or modified other than by *****. Our goal is to ensure that our customers are satisfied and happy with the clubs they have purchased from *****.

Can we ask to return them all for refund or under their warranty are we only allowed repairs, what's the situation especially as they do not stock these any more?

Thanks in advance.

Yes you can return them under the sale of goods act for not being fit for purpose

i would update them with todays situation and ask for a refund now as opposed to getting a new set from the manufacturer

Thanks for the reply, will email them shortly! Just wondering can we ask for them to pay for the return postage (or refund us it) its just as I am sure you can imagine a set of golf clubs is pretty heavy and we will be losing out big time with the P&P cost.

As the product is faulty, they should pay for you to return it.

May be helpful to try and get a written statement off the Pro who gave the lesson if they witnessed the clubs breaking to confirm that no misuse occurred ?

Sorry that's my fault I have just been told it was a round of golf (18 holes I think he said) not a session so there was no Pro :o His brother was there the first time his 6 iron broke and was there again today along with a friend, but he says he hit it cleanly and didn't hit the shaft or the floor when the 6 iron broke (whatever that means- as you can tell golf isn't my thing ;) )

We emailed them saying that we wished to return all the clubs, we said we wished for them to arrange collection (to ry and avoid having to pay for return p&p)
The reply I got (26th) I got was:
Good afternoon Rebecca and thank you for your email,

Sorry to hear about this second fault you have experienced. I have forwarded the photos to our supplier as we have not come across this kind of fault before. I will discuss this matter with my colleague to find the best solutions for you.

Please accept our apologies for any inconvenience caused.

Is there a certain timescale I have to allow them to sort it out? Just don't want to spend weeks being messed around waiting for a supplier to be told sorry nothing we can do! Thanks

Its now been 8 days since their last reply, so just sent another email asking for them to get intouch asap.
I thought I paid for these via paypal but I actually paid via my Visa Debit card, and have heard about charge backs but no idea when they can be used or how they work, does anyone have any advice on that?
    Thanks

Read MSE's Section 75 Refunds article.

There is a bit at the bottom about debit card chargeback.

Sound like pretty shoddy goods to me, considering the clubs i'm using are the best part of 30 years old (well, the irons anyways) i'd say poorly manufactured - now i know you're saying it's been 8 days, but bearing in mind that the last 8 calendar days have included 2 bank holidays & 2 days considered a weekend, i know it's not really brilliant, but that's only 4 business days and the manufacturer/supplier may well have shut down on Thursday night until yesterday morning. Stick with it a day or two longer then consider the chargeback idea on a serious scale, but i'd avoid whoever you bought those clubs from - 3 rounds & 2 clubs down is pretty dire.
