Why did you let the builders use your electricity?
Did you not agree to the terms of use before hand, I bet you let them use the loo too? And your water.

sold to a builder ,his first build on his own............ agreeded about elec,they would do some jobs for me.............. no access to the loo........it had outline pp before i sold ........... so fed up about this ...... only did this so i could help my lads through uni .0

OK, did you get anything from the builder in writing?
Your solicitor that you used for the land sale may be of some help, but will charge for their services.
The outline PP was not enough for the builder to start work unless he thinks he can get away with a retrospective application.
Go and see your local planning officer, they are very helpful.

no the builder got a full plan ........whatever you call it ............. will go back to solicitor after easter break thanks0

Does 10cm really make that much difference to your property? If it impinges on driveway access or something similar, I can see it would be a problem but maybe you could just learn to live with this?0

It can make a lot of difference.
10cm x the length of the driveway or what have you. That can be a big area, effectivly(sp) stolen from the OP.

If it was the fence line which could be easily moved, I would want it moved.
It's more difficult that it's the wall of the house. No-one is going to order a house to be knocked down because it's 10cm nearer another property - and Suzy says she wouldn't be asking for this anyway. In that respect, she will have to learn to live with the position of the house. It would be easy to let it rankle every time you looked at it but that will only lead to unnecessary stress.
It also takes some time to build a house. Suzy says she asked the builder not to dig the foundations until she was there and they went ahead but there would have been plenty of time to get the tape measure out while the wall was being built.
It would be worth negotiating with the builder for some compensation for the extra land now within the boundaries of the new house and definitely try to get the electricity costs from him. As they've built on the boundary, they must also have done a lot of the work from Suzy's land. She should be making sure that the builders reinstate that to the condition it was in before.
However, as it doesn't sound as if these agreements were put in writing before work started, he may not comply. It sounds as if the builder has taken advantage of Suzy.
Like Dippypud says, Suzy, I think you need to go back to the solicitor who dealt with the land sale. If the builder is planning to sell the house rather than live in it himself, you have some leverage in that few people will want to buy a house with a boundary dispute in place.0 -

There should be no encroachment of the boundary. I`m not sure where you took your measurements from and to but a house sits on a foundation which normally projects beyond the brickwork size, this is known as the scarcement. This scarcement should be within the boundary of the new build. Also if the house has eaves or gutters on the boundary side then they should be within the new build and not projecting over the boundary line. If they have an opening window then it also should not open over the boundary.
Boundary disputes will not come within building regulations but will be a civil matter, legal advice would be advised , legal action would probably be to costly but remember you are the injured party.0
