help needed re boundary lines please........

the plans for a new build were 3.7m from my house ........... measured yesterday and they are 3.6m ............ sorry .............. i sold the land to the builders and on the plans it was 3.7m from my house to there boundary ................but they have built it nearer

do i

A) are they measured from the centre of the bricks ?
B) ask them to knock the house down ( which i wouldn't do )
C) ask them to build me a garage ( single) as compensation
D) does building regs need to know ? :eek:

single parent with no confidence ........... as i was writing this they knocked on the door to talk about plasterers coming on tues ...... and i mentioned it ....... he said he must of measured wrong ! i said think about it over the Easter weekend ..............

please advise me ........... i have googled it but am no further forward

    So the house is 100mm (4inches) closer than you thought. How will that adversely affect you in any way. You are having a laugh if you expect to get a new garage out of it. Probably nothing to do with building regs, but if the actual position on the ground is that critical then possibly Planning might be interested.
    I can afford anything that I want.
    Just so long as I don't want much.

    You won't get a garage out of. YOU can't force them to do anything about it, unless its on your land. You need to advise planning control at your local authority. They will look into it. The land owner who has had the property built in the wrong place can seek retrospective planning permission and if that is granted then there is nothing you can do about it. If PP is n't granted the local authority can take enforcement action and have it pulled down, but that is in very extreme cases.

    thanks for the replies ....yes it is on my land ............ so what would you think is fair .......... they still owe me for all the electricity they have used .............. i have no idea so am i being too ambitious with a garage

    sorry .............. i sold the land to the builders and on the plans it was 3.7m from my house to there boundary ................but they have built it nearer ......... after asking numerous times not to dig until i was there when they measured it ... surely its not right thats theres nothing i can do ? thanks

    But you didn't explain that in your original post did you? Full facts would help.

    If they have built on your land then it is a completely different matter and is classed as trepass.

    You can have it knocked down or you can sell them the land at an exorbitant rate.

    You will need to see your solicitor though.

    phill99, at post number 3 is quite correct.
    there maybe a problem between the owner of the building and the local council. re the plans.
    its nothing to do with you at all.

    and the chances of the council making them pull it down/rebuild it are very very slim.
    Get some gorm.

    They have put up a dwelling on land that doesn't belong to them.
    phill99 is correct in post #6. Give them the option of paying enough to get a garage built or build it for you. Sounds to me like they are taking advantage of you being on your own. And don't forget the elctricity too.

    thanks i was thinking i was in the wrong !! will not be paying solicitors costs either cos it will have to be legal because if i come to sell my house there may be problems ...........

    I'm not sure I am clear about the problem.

    You sold some land and a house has been built on it which you think is 10cms nearer you than planned.

    Is the wall of the house now the new boundary between the two properties? Or is there a marked boundary between your house and the new house and it's just that the new house is slightly closer to yours that is the problem?
