Once you have successfully sued them take out a contract on all the Directors of Morrisons to make sure someone else does not have to suffer this fate worse than death:rotfl:

That's a bit harsh - killing the directors of Morrisons because of some mouldy pasta sauce from Sainsburys...
If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands

    Hi,

Have just bought some pasta sauce from Sainsbury's and it has evident mould in the top of the jar. It is within the expiry date (over a year!) and am wondering if there is a process of suing them or just getting a refund?

    Thanks

i think suing them is extreme and a bit daft

email sainsburys(or who ever makes it) and politely inform them of the sauce, dont say you expect some form of compensation in the region of whatever (i dont do this, i let the other party decide what to offer)

    How was it stored?

yes how was it stored, we've found some things have gone mouldy if near a heat source (without knowing it would happen) we came across some beetroot was mouldy as it was near a source of heat

Yes - or someone who was visually-challenged and had also lost their sense of taste/smell.

Also remember to apply for a super-injunction so your privacy is maintained and we don't all get jealous about the ££££s you are awarded.

Just take it back to the shop and speak politely to the manager. They will probably give you a few jars of an alternative as a replacement and a maybe a couple of gift vouchers for the inconvenience. They will also pull that batch of sauce off the shelves in case something has gone wrong with the whole batch (like the machinery sealing the jars airtight being faulty that day). So they will want to know that this has happened to your sauce.

(Exact same thing happened to my mum a few years ago and that's what the supermarket manager did. He was very pleased that she had reported it, so that the sauce could be taken off sale, and I think she got £40 of vouchers.)
Public appearances now involve clothing. Sorry, it's part of my bail conditions.

£40?? Just going off to open a few jars of stuff. How long do you think I should let them sit before returning them?

If there is mould growing in the lid then either someone has tampered with it in store - this should have been apparent as the pressure seal would have been broken, or there is a problem at the manufacturers with closures not being sufficiently tightened or bacteria surviving in jars which havent reached the required sterilisation temperature. Either way, first port of call is the supermarket but you may also wish to contact the manufacturer. Presuming that it is branded.

Storage shouldn't be an issue here. Once properly sealed and heated in the factory the jar's contents should be biologically inert. You can put your jars of food in a hot window if you like for months, they shouldn't ever go mouldy. The contents might chemically degrade a bit though, just not biologically, so I'm not advising this as a good place to keep them! It was probably not sealed right or not heated enough after sealing. So, just take it back to the store for replacement?

As for suing them, it could be worse, in medieval times butchers caught selling bad meat went to the stocks. However, in those grimy pre-refrigerator days their idea of bad meat was probably worse than we could ever imagine...
