ongoing dispute re goods not received, advice needed

hi, I paid for over £70 worth of goods last February, through paypal, from a site called #crafty Stash, which had good reviews also I know someone who used to design from them. Money went through on 13th Feb, goods were not shown as being dispatched until 9th March! You are asked to wait a certain number of days to allow for postal hold ups. I did this and then contacted the seller who said she had resent the goods on 2nd April 2010, again they never arrived. I got a form from the post office but was told I would need proof of postage from her to get a refund from them. Despite numerous e mail she has never replied, though she has removed my message on the guest book in her site asking her where my goods were. (of course after my order negative feedback kept appearing from other people with the same problem).The mobile telephone number just continues to ring. Obviously because of her delaying tactics by the time I realised the goods had not been sent it was too late to receive a refund from paypal. Am I within the statute of limitations to take her to small claims or is there anything else i can do? As I'm on dla I believe I do not have to pay for small claims.
Would be grateful for any advice.

    Have you tried to make a claim for a refund via paypal? You only have 45 days from date of purchase, so you maybe out of time for this.

    Wonder if it would be worth inquiring with paypal anyway, as there may be others making claims by the sounds of what you are saying, so they may consider helping.
  • about a year out of date to make a paypal claim, would like to report her though but not sure how.

    Oh you mean you bought the goods end of feb 2010 !! I thought you ment feb 2011 !

    Its probably far too late to do anything really to get your money back now.

    There may even be a time limit for small claims court. However it may be worth writing a 'letter before action' and stating you will persue through this route, give her a time limit to refund (7 days is reasonable).

    With several unhappy customers she may not want the hassle of a small claims case and agree to refund, however she may also be ignoring you because she thinks you have recieved the goods, or simply know that its too late for you to do anything.

    It maybe that you have to chalk this one up to experience, and learn not to let it drag on so long. With a paypal claim, if the seller can not prove you recieved the items (ie with a tracking number and signature) you would have won and got a straightforward refund.

    Thanks, I was googling to find if there was a limit!! I wanted to help the OP as she had not had any replies!
