Cars parking up a drive - my rights

    At the moment I don't know who the drive belongs too. If it's the business behind, they're not fine with it as such, they just don't know about it. They have a 24 hours access sign on their gate so probably won't be fine with it.
    I thought if you parked against a dropped kerb leading to someones drive that was illegal/unlawful as it's blocking their access.
  • This has probably nothing to do with the law: entirely civil matter unless the drive is classified as highway. You also have no rights to put a bin there or even walk there unless you have a lease that includes these activities as a benefit of paying rent. Having said that worth having a word with the police: sometimes they will caution and move on cars on the grounds that continuing to park there after the residents have expressed indignation may be action "liable to cause a breach of the peace"

    I took it to mean that the OP wanted to move the bin from further down the drive to the street for collection (and back again), with the drive being too narrow to wheel the bin past the parked cars. Presumably the OP does have the right to leave the bin further down the drive where it is normally kept as they are not the only person to do so.

    Yes, I couldn't get my bin out to put it on the street. The binmen usually come very early in the morning so I need to do it the night before. The flat above me has their bin there too as they have no outside space.

    it's a bit worrying if I don't have a right to walk there as that's the only access to my flat :eek:

    Well hopefully it has been solved by asking them not to park there. They moved the cars not long after I spoke to them. Well, don't know if they moved their cars or just went home. We will see.

    This would seem to be a communal access and it would seem likely that all the properties have an equal right of use. Just because fish supplier put up a sign does not give them any more right than you (or the young lads) to use the driveway.

    I would suggest you should try to reach an amicable agreement with your neighbours.

    As far as I am aware, it is only illegal to block someone in but not out.

    There are rights of egress on shared drives, and the council will get involved normally if they block access to putting rubbish out. Worth checking with the local office.

    They don't live here as they leave that same evening. If they were parked there in the morning they would be blocking in the fish supplier's vans.

    I get on fine with the neighbours, if I've ever had a problem I speak to the neighbour and everyone's been fine so far. These people weren't visiting anyone adjacent to the drive.
