Hi,
I recently sold 2 PS2 games on ebay. They were brand new and sealed as I wote in the description. One of the buyer received it perfectly fine and even sent me a +ve feedback, however the other one is saying that,it was not sealed and used and wants me to refund or send a new one.I am 100% confident that it was sealed and I still have got the recipt of my purchase,so I refused him to refund...now he has sent me the following msg,
"The item is NOT as described, I SHALL report this to Ebay and Paypal..but moreover, will take this to the County Court, you have sold goods NOT as described, and refused to give me my money back. I will give you untill 5pm today to refund the money or the next time you will be getting County Court documents..this will include all the costs damages etc"
He has a feedback score of 267 what should i do now?
Help me please!!!!!

you probably sold the ps2 game for 20 or under.
Noone takes anyone to court because of something this trivial, and even then, he did admit to receiving the item.
If the guy buying the item has high feedback +99% then it is strange he is doing this.
Ebay don't give a toss either. I know because I have been the complainer twice, and just get automated responses back half the time - for instance, after I paid 60 for a laptop which didnt even turn on, the seller basically laughed "i have the money now - get lost"
ebays response to this is "try going through the dispute console to settle amicably" as if he would be happy to swap back 60 for a brick.
It doesn't give you carte blanche to be a baddie on ebay, but you wont be doing jail time, or getting court letters. The most that will happen is he will leave negative feedback - i think he will.
MY ADVICE
If you genuinely sold him a new sealed copy of the game, and are sure he is trying to con you into refunding, if you leave negative feedback for him, then in the dispute resolution system, you can ask the buyer whether you both want to withdraw feedbacks (since he'll probably do the same) for this item, and remove record of this.
Since he might be protective over his feedback, he might agree, and all record will be wiped i think.0 -
you can offer to refund him on reciept of him returning the goods to you - but personally i would stick him out and go through the process of the claim - if he makes one - keep ur reciepts and use them as proof - im not sure he will go to the trouble of a CC claim for 2 games:rolleyes: Democracy is a process by which the people are free to choose the man who will get the blame.:j0

many many thanks for the reply...i was really scared..
I sold the item for £16.99 including the postage...
I also got ripped off twice by sellers but I never got my money back.Even once I sold a mobile and buyer paid through some fake account and then paypal took all the money in my account and sent my details to a debt collection company for the remaining amount and I paid an additional £150 to keep myself out of trouble...so I am really worried what action can this buyer take??
I"ll take your advice on board and act accordingly..
However many many thanks!0 -

i might have given him the refund but after receiving this threatening message I really don't want to...so I think I shuld wait for what he does next..0 -
Agree with the above comments. Stick this out and leave a negative feedback immediately to warn other sellers, make sure it is a calm and factual negative.
Games/CD/DVD etc can all be copied within minutes. If he starts to push this further check what else he has bought and contact sellers of similar items. You want to find out if this a trend.
Assuming you are sure it was sealed do not take any nonsense.0 -
well another message from the buyer:
I will be getting the forms on Monday...look forward to a Court Case
should i report to ebay?0 -
he cant really expect a refund untill the game is returned to you, send him a message explaining this.0

Tell them you look forward to receiving the game back so that you can check the security markings you put on it, and refund post haste. My TV is broken!

Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -
I would like to see the buyer take you to small claims court, it would be thrown out on the basis that he hasn't attempted to amicably settle a claim before taking court action. Also not sure why he is waiting for forms to arrive when you can fill in small claims forms online. Will also cost the buyer an additional £20/£30.
I think he is just trying to scare you, leave him negative feedback or say you will refund on receipt of the item back0 -
I had a very similar incident recently, I sold several PS2 games all identical and had great feedback on all except one. As yours were, mine were also brand new and sealed yet one buyer insisted theirs was not as described, tatty etc. I was threatened with neg feedback in their first contact with me. They did not want to return the item, but wanted money back in the end I refunded 50% just to end the matter.
Personally I wouldn't want the stress and would ask them to return the item for a refund as though this was no problem at all. I would not refund the full amount without the item being returned.
Good luck, some buyers are a pain (not all just some).0
