    That link says that you must have paid over £100, so it seemed to apply. We don't know how much each dress cost, but as she's checking with her credit card provider they will be able to advise her on best course of action anyway :)

    A quick check shows AX Paris don't sell dresses that cost in excess of £100 so a s75 claim would fail.

    S75 can only apply when the item cost is £100 or more, not the order cost. Examples:

    1. Item costs £75, 2 ordered for £150
    2. Item is a pack of 2 at £150

    S75 applies for number 2 but not for number 1.

    Hi, as quick as I can get it, hope you guys are able to help?


    Feb 2017 my Daughter bought an IPAD PRO via student portal.


    Apr 2019 Screen fault is noticed (It's a pressure related fault on the screen) on on 1 imaginary line full width of ipad screen swipe not affected moving apps across it is not possible is the best way to describe.)


    Apr 2019 Contact with re seller made (Multiple mails on consumer law exchanged and rights of thereafter, they in short state that as it's out of the 2 year warranty a latent failure/fault would have to be proven to be present from within the first 6 months of ownership) This is the only way to receive a replacement, (All recorded in mails)


    May 2019 Visit to Apple store and receive a genius report after inspection confirming no unit damage and no screen damage and identifies as a latent failure of the screen that requires a full unit swap out to resolve. (This should have allowed a return by the supplier at this stage?)


    May 2019 Sent re[port to ge-tech multiple mails back and forth from supplier saying they are chasing their supplier, polite manner now wearing thin.


    June 2019 Contact made with Apple support, advised of troubles with supplier, case raised and passed to senior advisor, he is currently looking at ways to possibly arrange an exception but has asked that I mail him back why consumer law should now entitle me to a replacement unit, he asked me to gain this from a legal avenue and to mail to him. He was a very nice chap and seemed very genuine so I believe if I do get this information to him it will allow him to easily arrange an exception and issue me with a replacement.


    If any help could be shared I would be an incredibly grateful fist time poster indeed!! Gracious thanks in advance my fellow MSE forum users :-)
  • Hi apologes if this is in the wrong thread. Quick question about Consumer Rights Act 2015 (I'm in scotland if that makes a difference) If the terms of a service as described on the website include full access to customer account statements for the lifetime of the account on request - and provider refuses/fails to provide any statements. Is this a breach of the terms or at the very least false advertising of the terms of the service?

  • do I have any consumer rights if I purchased a £50 restaurant gift card in supermarket. family member tried to use in restaurant but was rejected as card had no balance. supermarket saying it is provider fault as they are only merchant to sell card and have no responsibility. Choice card povider states supermarket did not validate or scan correctly and supermarket is at fault however wd fo have receipt to say validated. Currently awaiting outcome of choice card management checking out further but concerned I will be left in the middle of all this with no refund. Do I havd any statutory rights ad goods not received?
  • I bought a brand new car from Nissan and when it was delivered it was dirty. They paid for a valet which I did. I then discovered marks on the drivers side inside door all over the black plastic.. they are permanent. Nobody wants to take responsibility for these marks and to repair my car. SMH apparently were the company Nissan employed to valet and inspect me car before it was delivered to me. They are refusing to help. Where do I stand? Thank you for your help in advance!
  • I'm ordered a new sofa from SCS and only specified an ASAP delivery date, discussed with the salesman that I'd confirm a date once completion of a house was known.

    They've now been in touch to arrange delivery and stated they'll charge for storage if I delay beyond 2 weeks.

    Can they do this, given no date was agreed?

  • I left a supply agreement with TalkTalk on Monday 29th July at exactly 10.21am, when Openreach switched my line (and supply agreement) over to Plusnet. In short, TalkTalk were trying to insist I pay a whole months charges in advance (although I was only their customer for one day that month), which I refused to pay requesting them to send me a Final Account Bill. Now they (TT) have sent me a bill for advance charges WHOLLY OUTSIDE THE PERIOD WHEN I WAS THEIR CUSTOMER and have reduced it (but not detailed how) and state I owe them around £4.25.


    I believe that once a contact betwwen us has ended, I am entitled in law to have an itemised final account bill from them for final settlement of all monies due. Am I correct?
