Parking infront of Driveway?

Hi..

I have recently bought a new house in which it is down a private road.. the deeds of the house actually say the private road is for passing through (access only).. also signs saying no parking private road..

anyway, ther is only us and a neighbour.. we both have our own drives.. but the end of the private road leads to the bk enterance of some shops! also the other side of the lane is a FREE public carpark!

People keep parking opposite our drive which makes it really awkward to get out.. solicitors recently put up some poles because of an unsafe wall to advise ppl not to park there.. however now they jus park along side them which makes it so difficult to get out.. I have let that go and i jus do like a 10point turn to get out of my drive..

BUT now.. they are parking actually infront of my drive stopping both me an the neighbours from gettin in an out ATALL! i told them to move one day and they said.. sorry next time jus beep ur horn?? y should i have to beep my horn to get in my own drive??

What are the legalities of this? can i do anything to stop them parking infront of my drive?

Who owns the land that they're parking on?

Talk with the freeholder and neighbours and agree/allow a private clamping company (shudders) to clamp on that land - it should keep the smarter parker well away? ;-)

    So...

Your road (a private road) leads to [STRIKE]a public cark park at one end and[/STRIKE] the back entrance to shops[STRIKE] at the other[/STRIKE]?

[STRIKE]Who owns the public carkpark ? I assume you have Right of Way through this on your deeds ?[/STRIKE]

What is the back entrance to the shops ? Is this a public road ?

Is this the ONLY way to your private road ?

...then it may be a short-term solution? ;-)

Is there anyway that bollards can be erected to prevent this parking? That would be my best solution although the land owner would need to agree (and arrange and pay!). I hate clampers :(

What if someone is ill and an ambulance cant get through. Obviously some of these car parkers are so ignorant that they havent thought of this.

If it were me I would ask them not to do it again face to face. If you can't be there when they are I would put a note on their windscreen to say as much. Either way note down their licence plate. If they do it again, repeat. Then, third time, get some broken glass and put it under their back tires...they won't do it again.

Oh, and to preempt: 'it's illegal'. So? What isn't? It could even be illegal for them to park in the private road for all we know. The police won't help you. The courts will cost you time and money. What else is there? One thing is for sure: if it weren't illegal, you would do it without a second thought.
