Rent arrears and what to do about it.

Hi all. My tenants are currently 4 months into their 6 month AST. The second months' rent was late because they claimed the agent had failed to set up a standing order for the rent payments, but they did end up paying it and setting up a S/O. Subsequently they paid the next two months' rent by S/O, however, they are now 5 days late in paying this month. I have sent emails, tried to call them, text them etc (I can't pay them a visit as I live in Germany) and I have had no success in contacting them. Could anyone advise what my next course of action will be please?

    So far it sounds like they have a case against you for harrassment. 5 days late, you shouldn't be harrassing a tenant in this way, it's a criminal offence.

    I'm not harassing them. I just want to get hold of them to ask if there is a problem and try and come to some sort of arrangement.

    could you send them a letter by registered post so at least you will know that they have received it
  • To harass someone don't you have to have contact with them?
  • This should be covered by the terms of the lease so read it carefully; but generally, under English law, tenants do not have to pay rent and Landlords can do nothing about it

    What has the agent got to say?
  • The tenancy agreement says that if the rent is unpaid for 14 days after becoming due the landlord can at any time thereafter re-enter the premises and resume possession of it subject to first obtaining an order for possession from the court and the landlord shall remain entitled to pursue any loss, damage, expense or arrears etc.

    I am concerned about what happens at the end of the inital six month term, as I have not served a Section 21 Notice yet.

    Well get on and serve the notice then! That clause in the agreement is worthless.
