Found a double Disney DVD for £9.99, with one of the DVD's also being sold as a single for £15.99. Thought it was rather odd but as the double DVD was better value I bought it, had the DVD I wanted plus the bonus of a second one with some extra little shows on it.
Pay at the till for the DVD but collect it from another area. There they try to give me the single DVD claiming it's the same. I point out that it isn't, the empty box I've got is for the double.
They realise the single and double DVD sticker/till prices are round the wrong way, but instead of honouring the sale they PRETEND they can't because they don't have the double DVD.
Yeah, right! So this means they've got SIX boxes of a double DVD on the shelves but have NONE of the corresponding DVD's to put in them. I can see why they wouldn't want to make a loss, but have the guts to refuse to serve me, don't lie about stock being completely missing. Their stocktaking must be diabolical if all they get from their suppliers is empty packaging and they don't even notice!

Seen it all, done it all, can't remember most of it.

I'd write a nice letter to head office pointing out that the moment they accepted your payment they agreed to the contract of selling you product x for £9.99 - if they had spotted it at the till prior to you paying that would have been a different matter as they can withdraw the item and not complete the sale should they wish to do so.
In this event you would appreciate it if they could send you by return post the item you did infact pay for and they agreed to supply you for £x which so far they have failed to do. Include a photocopy of the receipt and send it recorded and hope they send you the DVD

While it's entirely plausible that they were pretending they couldn't find the dvd, to play devil's advocate, it's worth pointing out that they may genuinely have not been able to find one.
Quite often, shops will be sent 'display' or 'dummy boxes' for items. So the dvd cases on the shelves can sometimes just be that, cases, with no corresponding dvd. When somebody takes it to the till, the shrink wrapped box is obtained and the dummy box is returned to the shelf.
It's similar to the situation where I work, we have tickets with product information on them, and people assume that if there are no tickets, there is no stock, and if there are lots of tickets, there must be lots of stock. Alas, that's not the case, the tickets are there to give information on what's for sale, nothing more.0 -
I can only assume that the person on the till realised the mistake of one of their colleagues and pretended they were out of stock in order to avoid getting them into trouble. Perfectly understandable i think, annoying for you but no harm no foul.0

annoying for you but no harm no foul
"No harm" apart from the OP not getting the goods they wanted, and "no foul" apart from Toys R us not honouring a legal contract which was formed when payment was offered and accepted.
If they had made a mistake and didn't have the correct DVD, a good retailer would have offered to order it in from another store and send it on to the customer.0 -
Just tell them you understand that sometimes mistakes happen, and you are happy to wait for the double dvd to come back in stock.
Perhaps they could ring you when that happens.

just to avoid any potential confusion (and because i've seen it before), the store doesn't have any legal obligation to do this.helpful tips
it's spelt d-e-f-i-n-i-t-e-l-y
there - 'in or at that place'
their - 'owned by them'
they're - 'they are'
it's bought not brought (i just bought my chicken a suit from that new shop for £6.34)0 -

Are you sure about this?
I agree that up until the point payment has been accepted, the price tag on the goods is simply an "invitation to treat" and is not binding on either buyer or seller.
However, once payment was given and accepted, a contract has been formed, and unless agreed by both sides, the seller is bound to supply the goods.0 -
Persoanlly, I find that Jake is rather good on the old Fiddle Saturday Nights at the Dog and Duck.
I suppose though, E&OE cover this0 -
This whole complaint works on the assumption that the shop assistant was lying about not having any stock in. There is no concrete evidence that the assistant was lying therefore you could write as many letters as you like but I don't see legally they have to do anything. If they had said we have the item and you can't have it then that is a different matter. This is a system account and does not represent a real person.
