I honestly wouldn't worry.

If you're not downloading huge files or spending all your time on iPlayer, the likelihood of data charges being put on the guy's account are slim to none. And chances are they're on unlimited.

I would describe it as, say, if someone could park above your house. Floating in your air. Yes, if you have a freehold they're technically trespassing, but does it really matter?

The 'nicest' thing to do would be to share net costs. Why have a connection each if you don't need to? Sod the T&C's.
