Still fighting my own case which got more complicated recently with the addition of my identity being stolen by the new tennants of my old address.
My credit report now looks like a war zone with notes and CIFAS warnings all over it and the police aren't moving with great speed to sort it.
But your case is basically simple they haven't proved your ownership of the debt and until they do don't do nothing more than send that reminder letter to them asking for the second time for the signed agreement, with out it they cannot do more than try to scare you.
As for the council Tax thing, the point is you still were registered for council Tax at your old and new address RIGHT? if so they have the end and start dates for paying council Tax in both properties. this would give you the proof required unless of course the items were ordered while you lived at your parents and he was still in the old house in which case it is very difficult to prove your case.
As for the because it was a catalogue YADA YADA YADA cannot prove it wasn't you YADA YADA (i'm not jewish by the way) that they claim, it is all irelevant if they can't provide that signed agreement.
Anyway, chin up, Stiff upper lip and all that.

I was just wondering if anything more has happened with this case.
Interested as I had a run in with the same company a few years ago. A music club passed a debt onto them & contacted us by phone. To cut a long story short we had been in our new house 2 years, (taken phone number with us) phone call stating we owed money they confirmed delivery of the cds to the old address. We got a copy of the order which was very clearly NOT hubbys sig. However to stop the legal action WE had to report to the police, get a crime number & then pass it on to debt company.
This did not stop them sending a bailiff round a week after crime number submitted. Luckily we were out but as a credit controller I would not have been scared (V V angry though!) as I know the rights etc concerning bailiffs. After a furious call to a very rude operator finally got it sorted.
It seems that you are guilty until you can prove otherwise.NEVER ASSUME! :rolleyes:0 -
