The payment hasn't actually gone through so I've barred the payment anyway, I'll send them the letter asap hopefully it will resolve the issue0

Just one question though, this thinig about the 6 years, does it apply to when they last made contact i.e when the debt was supposed to have activated or when the account was closed.
When I spoke to the agency about it she said because the account wasn't closed until 2002 the year period is from then, or is she feeding me rubbish?:rolleyes:0 -
I'll stab a guess at 6 years from their last contact about the debt.0

The DCA was incorrect - although what else would one expect her to say :rolleyes: her primary interest is, after all, Littlewoods and the commission/profit that her company is likely to make out of the fact that you were unaware of your rights. :mad: :mad:I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.

As far as I can see it should be the other way around - they have to prove it was you, or you DON'T have to pay it. If it's the way she reckons then effectively they can ring up random people and say "you owe us £6000 and if you can't prove this debt isn't yours you have to pay us!!" Er, no, I don't think so. They have to provide you proof of when you incurred the debt and that you haven't paid it off, ie a series of statements. If they can't do that don't give them anything, particularly since you are absolutely sure you paid everything off.0 -

Rubbish!!!! She's telling you nonsense. If they can't provide written information about what the debt is for and when it was incurred, etc, tell them to clear off!! Legal action my foot. If it went to court they'd have to provide that information!! Of course they've got access to that information - if it exists in the first place0 -
Outraged on your behalf here! They have to prove the debt is yours, and they're just using bullying tactics here to try and scare you.
